Consider Adopting a Resolution Supporting the One -Community Project and Encouraging the Residents of Hillsborough to Participate in the One -Book -One Community Project (Please see Attachments & Explanation) 8. Consider Rescheduling the March 22A Public Hearings for the Proposed Grant and Peloquin Annexations to March 29th, due to the March 22id Joint Meeting with the County Commissioners (Please see Attachment) 9. Discuss Proposed Master Plan and Annexation for the Waterstone Development (Attachments include draft Master Plan, Updated Financial Analysis information, Information from deverlopers) A) Discuss Water/Sewer Fund issues that must be addressed by Waterstone and included in a Water & Sewer Extension Agreement: 1) Cates Creek Outfall: When, where, how far, and phasing, 2) Sewer pump stations and perpetual maintenance fees, 3) Water lines, 4) Contribution to pay for portion elevated storage tank, 5) Dedication of land to locate elevated water tank, and 6 -)-Any changes needed to the financial model. B) General Fund financial model and proposed capital contributions from Waterstone (e.g., how, when, what for, how much, and methods of securing payments from developers). C) Road improvements adjacent to the site. D) Timing issues — is the phasing plan OK? E) Cultural and environmental resources (e.g, old cobblestone trading path, old roadbeds, unique plant life, etc.). F) What is the Board's expectation for open space requirements on each pod? G) Building design specifics — does the Board wish to stipulate any requirements in this area (e.g., tie-ins to other architectural themes)? H) Is the proposed 12 units/acre OK for the apartements? I) Affordable housing component — how, when, where, and how much? J) Back-up plan for the community college? K) Remaining Master Plan Questions and Issues L) Other Waterstone Issues 10. Other 11. Adjourn MINUTES JOINT PUBLIC HEARING February 23, 2004 PRESENT: Mayor Joe Phelps, Frances Dancy, Mike Gering, Eric Hallman, Evelyn Lloyd, David Daniel (PB Chair), Joel Brinkley, Cathy Carroll, Matthew Farrelly, Paul Newton, Barrie Wallace, Bryant Warren PUBLIC: Scott Radway, Jack Smyre, Rob Wilson, Peter Henn, Eric Braun, Bill Brian STAFF: Greg Siler, Kenny Keel, Eric Peterson, Demetric Potts, Bob Hornik, and Margaret Hauth ITEM #1: Mayor Phelps called the hearing to order and passed the gavel to Planning Board Chair Daniel. Daniel welcomed everyone and briefly described the hearing process. ITEM #2: Hauth introduced the text amendments proposed for Section 23 to include phased development plans, or master plans, as a document that conveys vested rights to the applicant. She noted that providing vested rights provides a level of insurance to an applicant that they will be allowed to build a project in compliance with a master plan or phased plan. Hornik added that the vesting of rights is provided for in the general statutes and helps applicants secure financing for projects. He noted that the five-year provision is specified within the general statues. Commissioner Gering asked if a longer timeframe were allowed or desirable. Hornik noted that five years is the maximum, but extensions are permitted. He added that the limited time serves to encourage the applicant to proceed with the prof ect. Commissioner Hallman asked if construction conveys a vested right and Hornik says it does for the portion that is constructed, not unconstructed portions. Daniel asked whether a final completion date or expiration date was desirable. Hornik noted that 5 years was the maximum allowed under state law. Mayor Phelps noted that the 5 years ties up the town's water capacity for a long time. Hornik suggested including a start time as well as a condition on the master plan. Daniel asked whether the amendment would have an impact on any previous approvals, like Hampton Pointe and Hornik said it would not. Daniel asked if there were any public comments and there were none. Chair Daniel closed the public hearing and returned the gavel to Mayor Phelps. Mayor Phelps adjourned the hearing at 7:15 PM.
