A. 513.65 $ 700.48 The Council of the City of Medina met in regular session on Tuesday June 16, 1981 at 7:30 P.M. Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, William Reiser; Clerk - Treasurer, Donna Roehl; Public Works Director, Ron Duran; Planning and Zoning Administrator, JoEllen Hurr; Police Chief, Charles Hoover; Attorney, Richard Schieffer; Engineer, Dave Hansing Absent: Couneilmembers, Sarah Lutz and Thomas Crosby 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss the following agenda items: Hamel Water Tower painting Ervin Zwiefelhofer, Use of trailer during construction Joanne Haislet, application for non -intoxicating liquor license for horse shows 2. MINUTES OF JUNE 2, 1981 JoEllen Hurr asked that Item 5, Midland Nursery, Page 200 be amended to include a requirement that trucks be parked behind the building on the rear of the property. Motion by Scherer, seconded by Reiser to approve minutes of June 2, 1981, as amended. Motion declared carried 3. PUBLIC WORKS DEPARTMENT Northwestern Bell Telephone Co. Motion by Reiser, seconded by Scherer to adopt Resolution 81-25, allowing Northwestern Bell Telephone Co. to bury cable on Hamel Rd. near Parkview Dr. Motion declared carried Hamel Water Tower Ron Duran reported that an inspection of the Hamel water tower had been made and the engineer recommends that the inside of the tower needs to be sandblasted and refinished. Community Development Block Grant Funds in the amount of $10,000 are available for the project. Motion by Scherer, seconded by Reiser to order plans and specifications for repair of the Hamel water tower with costs to be paid from CDBG funds. Motion declared carried Independence Beach Well Ron Duran presented a quote from the Prest Co. regarding installation of equipment to pro- tect well motors from damage in the event of a power failure. The $1711. amount quoted would pay for equipment for the Hamel and Independence Beach wells and installation in the Indpendence Beach well but not the Hamel well. He reported that there have been approximately 11 power failures in the Independence Beach system since it way installed in 1975, some resulting in damage to motors. Donna Roehl reported that there is a. balance in the Independence Beach Construction Fund that could be used for that system. Motion by Scherer, seconded by Reiser to order the installation of the phase protection equipment for the Independence Beach well by the Prest Company. Motion declared carried Hamel Sewer Repair Ron Duran reported that they would be making repairs to the manholes in the Hamel area using Community Development Block Grant Funds. 4. POLICE DEPARTMENT West Hennepin Medina Police Merger Motion by Reiser, seconded by Scherer to hold a special meeting on June 23, 1981 at 8:00 P.M. to discuss a possible merger with the West Hennepin Police Department and to also discuss Cable TV for the Medina area. 5. PLANNfNG AND ZONING DEPARTMENT Ervin Zwiefelhofer Mr. Zwiefelhofer, 2932 Pioneer Tr. appeared to request that he be allowed to move a mobile home onto his property to live in while his house, that was struck by lightning and burned, is rebuilt. JoEllen Hurr reported. that Medina's ordinance allows such a structure provided that a building permit has been obtained. . Thomas Anderson asked that application for building permit be made within one month'of this date. Motion by Reiser, seconded by Scherer to allow Ervin Zwiefelhofer to move a mobile home onto his property at 2932 Pioneer Tr. to be used during construction of his house, for a period of six months or thirty days after completion of said house. Motion declared carried John Day JoEllen Hurr reported that plans for construction of an industrial building on Lot 10, Block 2, Medina Industrial Addition have been redrawn and have conformed to approval which had previously been given. Woodlake Sanitary Landfill JoEllen Hurr reported that Woodlake will be requesting a rezoning and Conditional Use Per- mit which will be heard at the July 14th Planning Commission meeting. They are also proposing that a fee be charged for road upkeep which would then be put into an escrow fund. She ex- plained a letter received from Bruce Liesch regarding a program of monitoring test wells and constructing monitoring wells; a project. that will be conducted in three stages at an approx- imate cost of $13,900 which will be paid by Browning Ferris. Motion by Scherer, seconded by Reiser to approve that the proposal of Bruce Liesch be carried out with the condition that Browning Ferris Industries reimburse the city for any costs incurred. Motion declared carried Conley Brooks Subdivision JoEllen Hurr reported that original resolution 80-39, approving the Brooks subdivision re- ferred to acreages that proved to be incorrect when property was surveyed. She presented a resolution using correct acreages. Motion by Reiser, seconded by Scherer to adopt Resolution 81-26, approving Conley Brooks subdivision subject to proper acreage amounts of 8.36 and 8.65 acres respectively. Motion declared carried Dog Kennels JoEllen Hurr reported that clarification of ordinances regarding kennel operations is needed as zoning ordinance definition is vague and Nusiance Ordinance # 162 allows for keeping of any number of dogs on property 22,000 sq. ft. or larger, without a permit. She reported that there are two existing problems in the city and clarification of the ord- inance would help. Dockside JoEllen Hurr presented plans for Dockside and stated that plans would need to be reviewed to determine if they meet Council guidelines for development. Discussion regarding whether or not plans should be reviewed by the Planning Commission. Richard Schieffer stated that Council should decide whether or not plans meet guidelines. Dave Hansing explained that plans appear to be very near to criteria set forth by Council. Discussion of limiting to single family units, restricting number of square feet and set- back from Lakeshore Ave. Attorney Schieffer explained that it ispossible to limit to single family units under an MR zoning. Council requested that additiona information be gotten before a public hearing would be held. Motion by Reiser, seconded by Scherer to hold a Preliminary Plat hearing on Dockside Devel- opment on Tuesday, July 7, 1981 at 8:00 P.M. Parker Products Jim Murdock presented revised landscaping plans for property located stated that they will add two, 22" trees along Tower Dr. and that an has been planted. Motion by Reiser, seconded by Scherer to approve new plans of Parker Le ue_r or Credit when work has been approved by the City. TAX REVIEW PETITIONS Donna Roehl reported that Lawrence Elwell, George Gubbins and Foss-DesMarais (Midland Nursery) have filed petitions for consideration of review of 1980 taxes and that Hennepin County has informed the city that the County Attorney would take charge of processing the petitions un- less the city wishes to process itself. Motion by Reiser, seconded by Scherer to agree that Hennepin County should handle. the tax petitions. Motion declared carried 7. CABLE TV Thomas Anderson explained in the Cable TV program. each city needs 2 members Attorney will receive $60 Members agreed to discuss that a resolution needs to be adopted by the city participating He stated that the committee is preparing a franchise and that and 2 alternate members on the committee. He stated that the per hour which will be divided equally among the four cities. the resolution at the June 23rd meeting. 8. JOANNE HAISLET Tim Haislet appeared to request.a non -intoxicating malt liquor license on behalf of his mother, Joanne Haisiet, to be used June 17-21st at Alpine Stables Horse Show. Attorney Schieffer explained that the city could not issue such a license as it only allows licenses to be issued to non-profit, charitable orgainizations under Ordinance 151. 9. BILLS Motion by Scherer, seconded by Reiser to pay the bills; Order Checks #9575-9577 in the amount of $700.48 and Payroll Checks #6262-6273 in the amount of $5680.13.
