A RESOLUTION: INITIATING AN AMENDMENT TO THE LEESBURG ZONING
ORDINANCE TO ALLOW FOR THE INCREASE IN HEIGHT WITHIN B-3
ZONING DISTRICTS THROUGH A SPECIAL EXCEPTION, WITH
CONDITIONS
WHEREAS, a letter dated July 9, 1999, was sent from Bob Sevila, representing
the Peterson Companies with regard to the pending Leesburg Commons rezoning
application, to the Mayor requesting the initiation of a zoning text amendment to allow
increased height in the B-3 zoning district through the Special Exception process; and
WHEREAS, town staff submitted a report dated July 16, 1999, which outlined the
purpose of the request and initial suggested minimum criteria as a starting point for
consideration of such amendment; and
WHEREAS, on July 20, the Planning and Zoning Committee of the Town
Council considered said request; and
WHEREAS, the Planning and Zoning Committee agreed to initiate said request
provided that it was understood that such initiation was for the purpose of determining
the appropriateness of the proposed zoning ordinance amendment and that such initiation
does not constitute a Council endorsement.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia
as follows:

SECTION I. Staff is hereby authorized to prepare Zoning Text Amendments for
consideration by the Planning Commission and Town Council for their evaluation and
recommendation concerning the appropriateness of increasing allowable building height
in the B-3 zoning district through the Special Exception process.
SECTION II. If such increase in height is deemed appropriate, conditions limiting
the location of buildings with such increase in height be developed and forwarded to the
Town Council.
SECTION m: This initiation is for the purpose of determining the appropriateness
of the proposed zoning ordinance amendment and that such initiation does not constitute
a Council endorsement.
