AUTHORIZING AN AGREEMENT AND APPROVING A
PERFORMANCE GUARANTEE AND WATER AND SEWER
EXTENSION PERMITS FOR EXETER HILLS SECTION 7A
WHEREAS, Council Resolution #97-123 adopted on May 27, 1997 authorized an
agreement and approved a performance guarantee and water and sewer extension permits for
Exeter Hills Section 7A; and
WHEREAS, the developer has not provided the bond from the American Insurance
Company and the construction drawings and final plat have not been released; and
WHEREAS, the developer wishes to move forward with construction of this project and
has requested approval of a corporate surety bond from the Amwest Surety Insurance Company
in the amount of $656,000.00 to guarantee the installation of the public improvements shown on
the plans approved by the Director of Engineering and Public Works for Exeter Hills Section 7A.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The Acting Town Manager shall execute the contract for public
improvements for the improvements shown on the plans approved by the Director of Engineering
and Public Works for Exeter Hills Section 7A.
SECTION II. The extension of municipal water and sewer for Exeter Hills Section 7A is
approved in accordance with Section 15-9 and 19-18 of the Town Code.
SECTION III. A corporate surety bond in a form approved by the town attorney from
Amwest Surety Insurance Company in the amount of $656,000.00 is approved as security to

SECTION IV.
rescinded.
Town Council Resolution #97-123 adopted on May 27, 1997 is hereby
