A RESOLUTION: PRESENTED September 14, 99-287 ADOPTED September 14, APPROVING THE VACATION OF PORTIONS OF AN EFFLUENT FORCE MAIN EASEMENT WITHIN NEW PUBLIC ROAD RIGHTS-OF-WAY IN THE NORTHLAKE DEVELOPMENT AND AUTHORIZING A QUITCLAIM FOR SIDEWALK/STREET LIGHT EASEMENT IN NORTHLAKE SECTION 1 WHEREAS, the right-of-way for new public roads to be constructed in Northlake Sections 1 and 4 and the relocation of existing Edwards Ferry Road crossover the existing Town of Leesburg 30 feet wide effluent forcemain easement recorded in deed book 1388 page 1097; and WHEREAS, the new and relocated public roads are within Loudoun county and will be owned and maintained by VDOT; and WHEREAS, VDOT will not accept land for right-of-way which is encumbered by easements; and WHEREAS, the portions of the existing effluent forcemain easement which are within the new public road right-of-way must be vacated; and WHEREAS, a land use permit will be issued by VDOT to the town for the operation and maintenance of the portions of the existing effluent forcemain within the public road right-of-way; and WHEREAS, an easement for future sidewalks and street lights in Section 1 was conveyed to the Town of Leesburg by the recordation of the subdivision plat for Northlake Section l; and WHEREAS, since Northlake is outside the current LeesbUrg Corporate Limits, easements for future sidewalks and street lights should not be conveyed to the town and should be conveyed to Loudoun County with provisions for future assignment to the Town of Leesburg THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. That portion of the effluent forcemain easement labeled as "C/L Ex. 30' EFFLUENT FORCEMAIN EASM'T, DB 1388 PG 1097 (PORTION HEREBY VACATED)" as shown on the record plat titled "Parcels 1 and 2 - Northlake Dedication of Right-of Way and Various Easements on the Lands of COSCAN Washington Inc" dated January 12, 1999 numbered 4025-ROW.DED prepared by Huntley, Nyce and Associates, Ltd in a form approved by the Director of Engineering and Public Works is hereby vacated. 1999 1999 A RESOLUTION: -2- APPROVING THE VACATION OF PORTIONS OF AN EFFLUENT FORCEMAIN EASEMENT WITHIN NEW PUBLIC ROAD RIGHTS-OF-WAY IN THE NORTHLAKE DEVELOPMENT AND AUTHORIZING A QUITCLAIM FOR SIDEWALK/STREET LIGHT EASEMENTS IN NORTHLAKE SECTION 1 SECTION II. That portion of the effluent forcemain easement labeled as "PORTION OF EX. 30' EFFLUENT FORCEMAIN ESM'T. DB 1388 PG 1097 HEREBY VACATED" as shown on the record plat titled "Section 1 Northlake" dated April 12, 1999 numbered 4025-SEC1 prepared by Huntley, Nyce & Associates, Ltd. in a form approved by the Director of Engineering and Public Works is hereby vacated. SECTION III. That portion of the effluent forcemain easement labeled as "PORTION OF EX. 30' EFFLUENT FORCEMAIN ESM'T. DB 1388 PG 1097 HEREBY VACATED" as shown on the record plat titled "Section 4 Northlake" dated April 14, 1999 numbered 4025-SEC4 prepared by Huntley, Nyce & Associates, Ltd. in a form approved by the Director of Engineering and Public Works is hereby vacated. SECTION IV. A quitclaim is hereby authorized for all sidewalk and street light easements conveyed to the Town of Leesburg as shown on the record plat titled "Section 1 Northlake" dated April 12, 1999 revised through June 22, 1999 prepared by Huntley, Nyce & Associates, Ltd. SECTION V. All deeds and other documents necessary for the vacation of the effluent forcemain easements and quitclaim of the sidewalk/street light easements shall be in a form approved by the Deputy Town Attorney.
