A RESOLUTION: PRESENTED October 12, 1999 99-315 ADOPTED October 12, 1999 AUTHORIZING SETTLEMENT WITH INTERNATIONAL PAVILION LIMITED PARTNERSI-ffP OF THE CONDEMNATION OF 1.2884 ACRES, MORE OR I.ESS WHEREAS, the adopted Comprehensive Town Plan shows Fort Evans Road as a four-lane divided road; and WHEREAS, a public hearing was held on August 10, 1999 to consider approving and declaring the public use and necessity for Fort Evans Road, authorizing an offer and condemnation proceedings for acquisition of fight-of-way dedication and easements for Fort Evans Road, and vacation of right-of-way on Fort Evans Road; and WHEREAS, it is necessary to acquire the right-of-way dedication and easements for improvements to Fort Evans Road on property owned by the International Pavilion Limited Partnership; and WHEREAS, the Town of Leesburg has reached a favorable settlement with International Pavilion Limited Partnership for the condemnation of 1.2884 acres of land, more or less for right-of-way dedication; and WHEREAS, the Deputy Town Attorney recommends authorizing the settlement, with International Pavilion Limited Partnership, of the condemnation of 1.2884 acres, more or less, in the amount of $44,000.00. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: -2- RESOLUTION: SETTLEMENT OF 1.2884 ACRES SECTION I. The Deputy Town Attorney is hereby authorized to complete the settlement with International Pavilion Limited Partnership of the condemnation of 1.2884 acres of land, more or less, for Fort Evans Road improvements as shown on the plat titled "Plat Show Boundary Survey Remainder of Parcel B" (Parts B1 and B2) Property of International Pavilion, L.P.", dated September 30, 1998 & revised through November 16, 1998, Plat No. RF-H13, by metes and bounds description attached hereto and made a part hereof, in the amount of $44,000.00. SECTION II. The Mayor is authorized to sign a release for such transfer in a form approved by the Deputy Town Attorney. PASSED this 12th day of October, 1999. ATTEST: Clerk Of Council ~arnes E. EVANS REMAINDER PART OF THE PROPERTY OF INTERNATIONAL PAVILION, L.P. DEED BOOK 1676, PAGE 1171 TOWN OF LEESBURG LOUDOUN COUNTY, VIRGINIA OCTOBER 1, 1999 Being all of that certain piece, parcel, tract or remainder of land known as the 1.2884 Acre Ft. Evans Remainder, otherwise shown on the certified boundary survey entitled, "Plat Showing Boundary Survey Remainder of Parcel "B" (Parts B 1 & B2) Property of International Pavilion, L.P." dated September 30, 1998 and revised through 11/16/98, Plat No. RF-H13 (prepared by Bowers & Associates, P.C.) and also referred to as the "1.2884 acres owned by International Pavilion Limited Partnership, located within Fort Evans Road" in The Town of Leesburg Ordinance No. 99-0-25, adopted August 10, 1999 and also being that certain portion of land omitted in DB 927, PG 1116 and corrected in DB 1676, PG 1171, all among the land records of Loudoun County, Virginia, and being more particularly described as follows: Beginning at an iron pipe found (IPF) at the southeasterly comer of Parcel B8, Fort Evans Division (DB 1647, PG 876), said IPF being in the line of Parcel 16, Cattail, L.C. (DB 1280, PG 498) and also being the northeasterly comer of the 1.2884 Acre Ft. Evans Remainder; Thence departing said Parcel B8, Fort Evans Division and running with said Parcel 16, Cattail, L.C. and with the herein described land; S 05024'50'' E, 35.37' to an IPF at the southeasterly comer of that portion of the (original) Fort Evans Tract described in a conveyance from Huntington Harris, et ux to Helmi E. Carr and recorded in DB 13L at PG 127, Thence departing Parcel 16, Cattail, L.C. and running with the southerly line of said (original) Fort Evans Tract (as now surveyed); N 55010'34'' W, 900.50' to a point, N 55009'06'' W, 1256.53' to an IPF (ref.
