RE: 3250 Polo Dr.
Bill,
The calculation show that they are meeting the 1" rule.
Why are they placing the trench in the right -of -way?
It does not appear they need it for retention. It appears that they just to make sure the water does not sit in the right -of-
way adjacent to the driveway.
So it looks like they are going the extra mile to ensure their property is dry on the adjacent right -of -way. If the trench had
to come out in the future that is in the right -of -way them it would not place them in non - compliance with the 1.0" rule.
Therefore, the system looks good to me.

Good Morning Brian
I need your services concerning the attached site plan.
Some background:
This is a revised site plan adding a new driveway cut nearest the garage. Previously the pavers stopped short of the
roadway and a retention area, similar in design to the two at the rear of the property, was provide.
The revised plan creates a new cut to the road, does away with the front retention area and creates two exfiltration
trenches /swales partly located on private property and partly on or in the Town's ROW.
I have recommended that the exfiltration trenches /swales be located exclusively on private property. Their engineer
have told the agent that to locate the system on private property is not possible or not as effective. I believe that the
auto court could be adjusted to provided enough area to place both trenches out of the ROW.
To my knowledge that are no other exfiltration systems in Town ROW, and for sure none that I have approved. I am
concerned that future maintenance of the trenches could be problematic. Neighbors could complain about water on
the road, which does happen, and want something done to clean or reconstruct the trenches. I don't want that possible
confrontation.
My Questions:
Could you recommend that the Town allow such trench systems in Town ROW? Absolutely not. If the town
went in there in the future to install utilities or drainage etc. their trench would be in conflict. It would prevent
the Town from doing anything in the right -of -way in this area. Just imagine if everyone did this. This would be
setting a president that would be hard to recover from. (Le. well he did it why can't 1 ?)
Is there an industry standard concerning regular maintenance or frequency of re- construction of such
trenches? No there is not. The only time I have been involved with the maintenance of exfiltration trenches is
when they fail. There is no real maintenance on these systems because they are like a closed system and can't
be opened up to 'fix ". You could design into the system sumps at the bottom of the inlets to trap sediments
before they get into the trenches or filters to stop the sediments from getting into the trenches but no, I know
of no maintenance you can do on the trenches themselves.
Could the auto /motor court be slightly reduced to allow safe flow of parking and provide trenches exclusively
on private property. Yes. There is nothing preventing them from placing the exfiltration trench under the
motor court. They would not have to reduce the size of the motor court just place the trench under it as it is
now.
Excluding the trenches, do the drainage calcs meet the current Town Standard of the V 1 inch. Send me the
calculations. Make sure they include a geotech report that gives a "K "factor. The engineer should know what
this is and why I would be asking for it.
Note: I need to finalize my staff report on this site plan by March 13. Could you give me your opinion or thoughts
before that date?
Thanks Brian,
M

Happy New Year.
Do you want me to contact the engineer to see where they are on the project and I can request a formal surety bond
reduction with the engineer's back -up showing the remaining work to be completed? Or, if all the bonded improvements
are completed and certified by the engineer, we can entertain a request to close out the bond.
Either way, I can contact the project engineer to see where they are.
Do you have any problem with either of these senerios?

The surety amount as of this date has not been reduced to the $332k and remains at $355,773. The Insurance company

reduced to the last recommendation ($332k) but will go by what you say.

TOWN OF GULF STREAM
PALM BEACH COUNTY, FLORIDA
Delivered via e-mail
May 13, 2015
Asset Enhancement, Inc. [mail to: records @commerce- group.com],
Re: GS #1806 (1061)
Provide a copy of all documents (including, without limitation, billings, payments, plans,
estimates, contracts, drafts of contracts, memos, letters, and emails ("documents')
generated, stored, created or received by the Town of Gulf Stream (including any of its
lawyers) which documents include where the sender or a receiver is a party whose email
address ends as follows: "@ionesfoster.com "; " @wantmangroup.com ", "@gulf -
stream. org" and /or "@rweetapplelaw.com" (the "original parties') where the sender or
receiver were any of the original parties. This request is made for the period beginning
January 1, 1014 through the date of this request.
Dear Asset Enhancement, Inc. [mail to: records(2 commerce- group.coml,
The Town of Gulf Stream received your public records requests on March 11, 2015. You should
be able to view your original requests at the following link http://www2.gulf-
stream.ore/WebLink8 /0 /doc /40860 /Paeel.aspx. In future correspondence, please refer to this
public records request by the above referenced numbers.
Your request is extremely broad, requesting as it does any public records created by the Town
and shared internally among its employees with e-mail addresses ending in @gulf - stream.org. It
thereby encompasses all of the daily operations of the Town from January 1, 2014 to the date of
the request in March 2015, more than one year later.
Your request also broadly seeks public records of the Town sent or received by its outside
counsel. As you are well aware, the Town was involved in dozens of lawsuits during this time,
including more than 40 public records lawsuits (including suits brought by you), several other
suits against the Town in state and federal court and a putative class action brought by the Town
and co- Plaintiff the Wantman Group, Inc. against Martin O'Boyle and various of his corporate
entities, including you, among others on February 12, 2015. Your request thereby encompasses
encompasses documents prepared by the Town's attorneys exclusively for the litigation or in
anticipation of imminent litigation and that reflect the mental impressions, conclusions, litigation
strategies, or legal theories of the Town's attorney or the Town and would be exempt under
Florida Statute 119.0171(1)(d)l until the conclusion of the litigation.
The Town notes that given the breadth of your request, the Town has likely produced documents
responsive to your request in response to other public records requests made to it since January
1, 2014. Such records can be found by going to www.gulf- stream.org click on "I Want To... ",
click on "Find a Town Record ", click on "Public Records Requests ", click on "2014" and
"2015 ", click on " Public Request Number Log" to review the requests for subcategories of the
documents you seek. You will then be able to locate the requests and responses by going to
"Public Records Requests 2014" and "Public Records Requests 2015" and searching under the
number associated with the given public records request.
After conducting an initial review, the Town has found a limited number of e-mail received from
e -mail address(es) ending in @wantmangroup.com. The Town is thus able to make a partial
production to you, which is available at http://www2.Pulf-
stream .org /WebLink8 /0 /doc /40860/Paae l .asox.
To search for additional responsive documents, assess whether they constitute public records and
determine if any exemption applies will require significant time and expense.
The Town estimates at least 40 hours of administrative support at $36.39 per hour, 20 hours of
administrative support at $50 per hour, and at least 12 hours of attorney support to review for
exemptions related to ongoing litigation at $235.00 per hour, the labor cost of the personnel
providing the service, per Fla. Stat. § 119.07(4)(d). If you would like to narrow the scope of
your request, for example, by identifying a particular document type or date range, the Town
maybe able to provide these records at a lower cost.
(40 hours @ 36.39 = 1,455.60) — (.5 hours @36.39 = 9.10) + (20 hours @ 50.00 = 1,000.00) +
(12 hours @235.00 = 2,820.00) = Deposit Due: $5,266.50 in cash or check.
The Town of Gulf Stream is currently working on a large number of incoming public records
requests. Upon receipt of your deposit, the Town will use its very best efforts to further respond to
your public records request in a reasonable amount of time.
Sincerely, Town Clerk
