- INITIAL REVIEW AND REVIEW PROCESS
At the Town's request, the proposed subdivision and re -plat of the 2.43 -acre parcel of
land at 1424 North Ocean Boulevard, as depicted in the January 13, 2014 Preliminary
Lot Layout Plan prepared by Rustem Kupi Architects, has been preliminarily reviewed for
consistency with the Town's regulations.
The proposed subdivision will create two (2) residential lots which is consistent with the
densities permitted by the Town's SF (Single Family) Future Land Use designation and
the applicable RS -Ocean West zoning designation.
The following is a preliminary analysis of the proposed subdivision. Additional
comments will be provided once the subdivision application is completed.

The proposed subdivision will require three concurrent review processes.
Those processes are:
Subdivision Re -Plat Process, consistent with Chapter 62, Subdivision, of the
Town's Code of Ordinances.
Concurrency Certification, consistent with the rules and standards of Chapter 44,
Concurrency Management System, of the Town's Code of Ordinances. This

process will confirm that there are sufficient municipal services for the additional
unit proposed.
• Level 3 Site Plan Review, consistent with Section 66 -140, Architectural /Site Plan
Review — Levels 1, 2 and 3, of the Town's Code of Ordinances.
All three processes will require review by Town Staff, the Architectural Review and
Planning Board and the Town Commission.
Along with the standard application requirements required by the Town, the applicant
will need to address each of the subdivision criteria outlined in Section 62 -10.
The three identified development review processes above require the submittal of plans
and documents to the Town to demonstrate compliance with the Town's
Comprehensive Plan, Code of Ordinances, state regulations and all applicable rules and
standards. Below is a listing of such plans and documents:
Subdivision Re -Plat Process
1. Application Fee to be determined by the Town.
2. Written and notarized consent of the owner for the requested subdivision and
designation of agent.
3. Warranty Deed of the property and copies of all easement and plat documents
on or adjacent to the property or serves the property.
4. Aerial Location Map with the appropriate zoning and future land use information
for the site and surrounding properties.
5. A certified boundary survey by a surveyor registered in the state of Florida at a
scale of not less than one inch equals 200 feet containing the following
information:
a. An accurate legal description of the property;
b. A computation off the total acreage of the parcel to the nearest tenth of
an acre;
c. Topographical data;
d. The location of all existing structures on the site, as well as those on
adjacent properties within 100 feet of the outside boundaries of the site;
e. Location and width of all existing driveways, streets (named),
intersections, easements and utility locations (underground and
overhead) adjacent to and across the subject site.
Plat Plan, compliant with Section 177 of Florida State Statutes, indicating the
proposed subdivision. The plat plan should indicate all existing and future
easements, restrictions and common -owned property, if any.
A written narrative describing the request and indicate how the following
services will be provided to the site:
a. Potable water;
b. Sanitary sewer;

c. Drainage;
d. Access /Traffic Circulation;
e. Solid Waste disposal.
Concurrence Certification
1. Application Fee to be determined by the Town.
2. Written and notarized consent of the owner for the requested concurrency
certification and designation of agent.
3. Warranty Deed of the property and copies of all easement and plat documents
on or adjacent to the property or serves the property.
4. A certified boundary survey by a surveyor registered in the state of Florida.
5. A traffic impact statement, prepare by a traffic engineer, indicating how the
proposed increase in the number of dwelling units on the site will comply the
Town's Level of Service standard as described within the Town's Comprehensive
Plan and the applicable traffic circulation standards in Chapter 44 of the Code of
Ordinances. The applicant will also provide to the Town a copy of Concurrency
Certification from Palm Beach County Department of Engineering.
6. Provide a statement from a qualified professional regarding the provision of
sanitary sewer service for the proposed subdivision. The plan for sanitary sewer
service shall comply with the Town's Comprehensive Plan and Section 44 -102 of
the Code of Ordinances.
7. Provide a statement from the City of Delray Beach that potable water service can
be provided for the additional dwelling units proposed. Also, the applicant
should provide a statement on how the proposed subdivision would comply with
the Town's Comprehensive Plan and Section 44 -59 of the Code of Ordinances.
8. Provide a statement from a registered civil engineer addressing how stormwater
drainage will be addressed on site. The statement should include how the
subdivision's stormwater drainage plan will comply with the Level of Service
standard as described in the Town's Comprehensive Plan and Code of
Ordinances.
9. Provide a statement on how solid waste will be collected and disposed for the
subdivision's homes. Provide a copy of the annual capacity letter from the Solid
Waste Authority of Palm Beach County.
10. Provide a statement addressing how the additional dwelling units within the
proposed subdivision addresses the Recreation and Open Space Level of Service
found in the Town's Comprehensive Plan.
Level 3 Site Plan Review
1. Application Fee to be determined by the Town.
2. Written and notarized consent of the owner for the requested Level 3 Site Plan
Review and designation of agent.
3. Warranty Deed of the property and copies of all easement and plat documents
on or adjacent to the property or serves the property.

6. Site Plan depicting the entire site. The Site Plan shall include the following
information:
i. Location of wooded areas existing or proposed water bodies, and
other environmentally - sensitive lands.
ii. The location of all existing structures on the site, as well as those
on adjacent properties within one hundred (100) feet of the
outside boundaries of the site.
iii. The use and approximate dimensions and location of all proposed
buildings and other structures.
iv. The number of dwelling units by type and gross floor area of non-
residential structures proposed, if any.
v. All existing and proposed means of vehicular access to and from
the site, and the location and width of proposed streets,
walkways, and off - street parking facilities for the various buildings
and uses
vi. Centerline and ultimate rights -of -way dimensions for roads and
canals (note if existing, proposed, dedicated, reserved, etc.)
vii. The location and width of proposed and existing driveways,
streets (named), intersections, easements and utility locations to
and across the subject site.
viii. Evidence of compliance with all applicable environmental
ordinances.
ix. The location and size of open space and recreation areas,
including docks and common structures, and the form of
organization proposed to own land and maintain said areas.
x. Proposed location, size and type of permanent outdoor signs, if
any.
xi. Indication of all exterior lighting, location, height, type, foot
candles, including cut sheets.

xii. Zoning category of the site and all parcels within 150'.
xiii. Land use of the site and all parcels within 150'.
xiv. Site Data information providing the following:

5. Date Plans prepared and subsequent revisions
6. Total acreage of site

7. Landscape Plan indicating compliance with Sections 66 -396 through 66 -402, 70-
146 and Section 66- 144(b) of the Code of Ordinances. The Landscape Plan shall
indicate all existing and proposed landscaping including the location of landscape
buffers or screening walls along roadways, with landscape plans for entrance
features, subdivision streets, buffers and common areas. Landscape Plans shall
include safe sight triangles.
8. Preliminary Drainage and Utilities Plans indicating proposed easements,
structures, retention areas, etc.
Summary
After the initial review, the proposed subdivision appears to meet all of the Town's
requirements and standards. After the above - referenced application documents are
submitted, we will be able to make a final recommendation.

The calculation show that they are meeting the 1" rule.
Why are they placing the trench in the right -of -way?
It does not appear they need it for retention. It appears that they just to make sure the water does not sit in the right -of-
way adjacent to the driveway.
So it looks like they are going the extra mile to ensure their property is dry on the adjacent right -of -way. If the trench had
to come out in the future that is in the right -of -way them it would not place them in non - compliance with the 1.0" rule.
Therefore, the system looks good to me.

I need your services concerning the attached site plan.
Some background:
This is a revised site plan adding a new driveway cut nearest the garage. Previously the pavers stopped short of the
roadway and a retention area, similar in design to the two at the rear of the property, was provide.
The revised plan creates a new cut to the road, does away with the front retention area and creates two exfiltration
trenches /swales partly located on private property and partly on or in the Town's ROW.
I have recommended that the exfiltration trenches /swales be located exclusively on private property. Their engineer
have told the agent that to locate the system on private property is not possible or not as effective. I believe that the
auto court could be adjusted to provided enough area to place both trenches out of the ROW.
To my knowledge that are no other exfiltration systems in Town ROW, and for sure none that I have approved. I am
concerned that future maintenance of the trenches could be problematic. Neighbors could complain about water on
the road, which does happen, and want something done to clean or reconstruct the trenches. I don't want that possible
confrontation.
My Questions:
Could you recommend that the Town allow such trench systems in Town ROW? Absolutely not. If the town
went in therein the future to install utilities or drainage etc. their trench would be in conflict. It would prevent
the Town from doing anything in the right -of -way in this area. Just imagine if everyone did this. This would be
setting a president that would be hard to recoverfrom. (i.e. well he did it why can't 1 ?)
Is there an industry standard concerning regular maintenance or frequency of re- construction of such
trenches? No there is not. The only time 1 have been involved with the maintenance of exfiltration trenches is
when they fail. There is no real maintenance on these systems because they are like a closed system and can't
be opened up to 'fix ". You could design into the system sumps at the bottom of the inlets to trap sediments
before they get into the trenches or filters to stop the sediments from getting into the trenches but no, 1 know
of no maintenance you can do on the trenches themselves.
Could the auto /motor court be slightly reduced to allow safe flow of parking and provide trenches exclusively
on private property. Yes. There is nothing preventing them from placing the exfiltration trench under the
motor court. They would not have to reduce the size of the motor court, just place the trench under it as it is
now.
Excluding the trenches, do the drainage calcs meet the current Town Standard of the 151 1 inch. Send me the
calculations. Make sure they include a geotech report that gives a V "factor. The engineer should know what
this is and why 1 would be asking for it.
Note: I need to finalize my staff report on this site plan by March 13. Could you give me your opinion or thoughts
before that date?

I need your services concerning the attached site plan.
Some background:
This is a revised site plan adding a new driveway cut nearest the garage. Previously the pavers stopped short of the
roadway and a retention area, similar in design to the two at the rear of the property, was provide.
The revised plan creates a new cut to the road, does away with the front retention area and creates two exfiltration
trenches /swales partly located on private property and partly on or in the Town's ROW.
I have recommended that the exfiltration trenches /swales be located exclusively on private property. Their engineer
have told the agent that to locate the system on private property is not possible or not as effective. I believe that the
auto court could be adjusted to provided enough area to place both trenches out of the ROW.
To my knowledge that are no other exfiltration systems in Town ROW, and for sure none that I have approved. I am
concerned that future maintenance of the trenches could be problematic. Neighbors could complain about water on
the road, which does happen, and want something done to clean or reconstruct the trenches. I don't want that possible
confrontation.
My Questions:
Could you recommend that the Town allow such trench systems in Town ROW? Absolutely not. If the town
went in there in the future to install utilities or drainage etc. their trench would be in conflict. It would prevent
the Town from doing anything in the right -of -way in this area. lust imagine if everyone did this. This would be
setting a president that would be hard to recover from. (i.e. well he did it why can't 0)
Is there an industry standard concerning regular maintenance or frequency of re- construction of such
trenches? No there is not. The only time I have been involved with the maintenance of exfiltration trenches is
when they fail. There is no real maintenance on these systems because they are like a closed system and can't
be opened up to 'fix ". You could design into the system sumps at the bottom of the inlets to trap sediments
before they get into the trenches or filters to stop the sediments from getting into the trenches but no, I know
of no maintenance you can do on the trenches themselves.
Could the auto /motor court be slightly reduced to allow safe flow of parking and provide trenches exclusively
on private property. Yes. There is nothing preventing them from placing the exfiltration trench under the
motor court. They would not have to reduce the size of the motor court, just place the trench under it as it is
now.
Excluding the trenches, do the drainage calcs meet the current Town Standard of the 111 1 inch. Send me the
calculations. Make sure they include a geotech report that gives a "K "factor. The engineer should know what
this is and why I would be asking for it.
Note: I need to finalize my staff report on this site plan by March 13. Could you give me your opinion or thoughts
before that date?

Happy New Year.
Do you want me to contact the engineer to see where they are on the project and I can request a formal surety bond
reduction with the engineer's back -up showing the remaining work to be completed? Or, if all the bonded improvements
are completed and certified by the engineer, we can entertain a request to close out the bond.
Either way, I can contact the project engineer to see where they are.
Do you have any problem with either of these senerics?

The surety amount as of this date has not been reduced to the $332k and remains at $355,773. The Insurance company
is asking for the status of the bond. I do not believe you have conducted a final inspection and the amount should be
reduced to the last recommendation ($332k) but will go by what you say.
