HomeMy Public PortalAbout1999_11_09_r331 Recommending Utilities not be extended to Dunlyn ProjectThe Town of Leesburg, Virginia RESOLUTION NO. 99-331 PRESENTED November 9, 1999 ADOPTED November 9, 1999 A RESOLUTION: RECOMMENDING THAT UTILITIES NOT BE EXTENDED TO THE PROPOSED DUNLYN PROJECT (LOUDOUN COUNTY REZONING ZMAP 1999-0018) WHEREAS, Dunlyn, LLC Bryan Brooks applied to Loudoun County for a rezoning of A- 3-zoned land to permit 529 single family detached and 320 single family attached (townhouse) dwelling units totaling $49 dwelling units, on 314.25 acres; and WHEREAS, said rezoning is located within the Town's Urban Growth Area and at least one mile from the southernmost corporate town boundary; and WHEREAS, the Urban Growth Area Element of the Town Plan (Utilities Policies) state that "Utilities infrastructure shall be extended into the urban growth area only where property to be served in the urban growth area is adjacent to developed property within the town limits"; and WHEREAS, there is approximately one mile of land between the town limits and the site of the proposed rezoning and that intervening land contains no public water or sewer service; and WHEREAS, the Annexation Area Development Policies state "The enlarged Town limits have been established as a boundary line beyond which central water and sewer service should not be provided in order to concentrate growth in and around the Town with the exception that the Town may choose to serve the recreational use approved by the Board...", and "The decision for extending utilities beyond the annexation area, except as specified above, will require concurrence by the Town of Leesburg and Loudoun County, as well as the issuance of a Commission Permit by the County pursuant to the Loudoun County Zoning Ordinance."; and WHEREAS, the proposed rezoning, if approved, would be contrary to the AADP agreement to concentrate growth in and around the Town in that there is a considerable distance between the town limits and the proposed development that contain large tracts of developable land with no provision for public water or sewer service at this time; and WHEREAS, such residential development would not result in a responsible, cost-effective development pattern with regard to the provision of public infrastructure at this time; and 2 A RESOLUTION REGARDING THE PROPOSED DUNLYN PRROJECT WHEREAS, extension of public utilities or other major public infrastructure into or within the Urban Growth Area should occur only where it can be demonstrated that proposed "development generates more revenue than the cost of required services" (General land Use Policy 10); and WHEREAS, employment uses are more likely to meet this cost/revenue test than residential uses; and WHEREAS, the Planning and Zoning Committee of the Town Council met on November 3, 1999, and directed that this resolution be prepared for consideration by the full Council; and WHEREAS, staff recommends that the Town Council respond to the County that Town water and sewer will not be provided at this time because the provision of such facilities is inconsistent with existing town policies: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I: The town will not provide water and sewer to the Dunlyn site at this time for the following reasons: 1. The proposal is inconsistent with the Town Plan and the AADPs 2. The proposal has not demonstrated that it will result in a cost-effective development pattern with regard to the provision of public infrastructure 3. Given the land use patterns and infrastructure availability in the area, this rezoning is premature. SECTION II: The Town Manager is directed to deliver this resolution to the appropriate officials of Loudoun County. SECTION III: This resolution shall become effective upon adoption.
