HomeMy Public PortalAboutResolutions-2009-38 (3)RESOLUTION 2009-38 A RESOLUTION TO APPROVE THE CONVEYANCE OF AUDITOR PARCEL 2009066 TO LITTLE CLIPPERS DAY CARE FACILITY WHEREAS, the City Council -of Tiffin, Iowa desires to convey Auditor Parcel 2009066 Legal Description below to Little Clipper Day Care for fair market,value and in exchange for improvements made to said parcel for parking and sidewalks. Legal Description of Auditor's Parcel 2009066 described below: A part of Out Lot A of Deer View Estates Part One, Section 28-80-07, City of Tiffin, Johnson County, Iowa according to the plat recorded in Plat Book 52, Page 155 in the office of the Johnson County Recorder and more particularly described as follows: 'Beginning at the Southwest corner of Lot 2 in said Deer View Estates Part One; thence. N89035'51 "E along the South line of Lot 2 a distance of 125 feet to the Southeast corner of said Lot 2; thence S00°45'39"E a distance of 19.00 feet to a point on the North line of Buck Street_; thence S89°32'35"W alongNorth line of a distance of 106.12 feet; thence 29.73 feet along a 19.00 foot radius curve concaved Northeasterly, whose 26.79 foot chord bears N45034'54"W to the point of beginning containing 2,298.70 square feet. BE IT THEREFORE RESOLVED The City Council of Tiffin having heard and reviewed comments made by or submitted by the residents of Tiffin at Public Hearing and not having concerns for the conveyance of the above described Auditor's Parcel approve the conveyance of said Auditor's Parcel for a Fair Market Value and in exchange for improvements made to the parcel for a hard surfaced parking area with curb and gutter to be included in the calculation for the minimum of 20 parking spaces for the Day Care Facility site and a placement of a 4' sidewalk in front of the curb as detailed on the previously approved site plan for the Day Care Facility at the,time that the site plan was approved for the Special Exception Use application for a commercial day care facility in a residential zoned area. Builder Empire Construction and.Owners of Little Clippers Day Care have agreed to the terms described above on land conveyed from and the additional parking spaces on city property adjacent to the above described land for the fair. market value.
