RESOLUTION NO. 99- 367 ADOPTED December 14, 1999
A RESOLUTION: AUTHORIZING A TIME EXTENSION FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING A PERFORMANCE GUARANTEE
FOR RIVER CREEK PHASE II SECTION 3 & 3A (LANDBAY D)
WHEREAS, River Creek L.L.C., the developer of River Creek Phase II Section 3 & 3A (Landbay
D), has not completed all the required public improvements in accordance with the approved construction
drawings and town standards within the two-year period agreed to in the contract for public
improvements; and
WHEREAS, this subdivision is in Loudoun County and the town's bonded improvements are
water and sanitary sewer only; and
WHEREAS, a corporate surety bond in the amount of $42,514.67 from the Fidelity and Deposit
Company of Maryland was provided by the developer to guarantee the installation of public
improvements in River Creek Phase II Section 3 & 3A (Landbay D); and
WHEREAS, the Director of Engineering and Public Works recommends a one (1) year time
extension for completion of public improvements for River Creek Phase II Section 3 & 3A (Landbay D).
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The corporate surety bond from the Fidelity and Deposit Company of Maryland
in the' amount of $42,514.67 is approved to guarantee the installation of public improvements in River
Creek Phase II Section 3 & 3A (Landbay D).
SECTION II. A one (1) year time extension for completion of the public improvements is
approved.
