RESOLUTION NO. 99-369 ADOPTED December 14, 1999
A RESOLUTION: AUTHORIZING AN AGREEMENT FOR MAINTENANCE OF THE
KOUSA DOGWOOD TREES IN THE ROUTE 7/15 BYPASS RIGHT-
OF-WAY WITHIN THE LEESBURG CORPORATE LIMITS
WHEREAS, the Dogwood Committee donated and planted 346 Kousa Dogwood trees in
the fight-of-way of the Route 7/15 Bypass within the corporate limits of the Town of Leesburg;
and
WHEREAS, the Kousa Dogwood trees were planted by Blake Landscapers, Inc. by
contract with the Dogwood Committee; and
WHEREAS, the town agreed to maintain the Kousa Dogwood trees planted in the Route
7/15 Bypass right-of-way once the one year warranty provided by Blake Landscapes, Inc. ends;
and
WHEREAS, a permit was obtained from the Virginia Department of Transportation
(VDOT) for planting the trees and a requirement of the permit is for a governmental agency to
take responsibility for maintenance of the Kousa Dogwood trees; and
WHEREAS, the Dogwood Committee has requested that the town sign a contract with
Blake Landscapes, Inc. which would permit the town to oversee and administer the warranty
section of the contract with the Dogwood Committee; and
WHEREAS, administration of the warranty section of the Blake Landscapes, Inc.
contract will satisfy VDOT's requirement and also assist the Dogwood Committee; and
WHEREAS, the Director of Engineering and Public Works recommends approval of the
proposed agreement.

KOUSA DOGWOOD TREES IN THE ROUTE 7/15 BYPASS RIGHT-
OF-WAY WITHIN THE LEESBURG CORPORATE LIMITS
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
The Town Manager is authorized to sign an agreement with the Dogwood Committee and
Blake Landscapes, Inc. in a form approved by the Deputy Town Attorney for administration of
the one (1) year warranty period for all the Kousa Dogwood trees planted in the right-of-way of
the Route 7/15 Bypass within the Leesburg corporate limits.
