A RESOLUTION: AUTHORIZING A TIME EXTENSION FOR COMPLETION OF
PUBLIC IMPROVEMENTS AND APPROVING A PERFORMANCE
GUARANTEE FOR TAVISTOCK FARMS SECTION 9, 10, (ll&12),
(13,19,20&21), 14, 18, & OFFSITE WATERLINE AND MAKING A
REDUCTION OF THE PERFORMANCE GUARANTEE FOR
TAVISTOCK FARMS SECTIONS 10, 14 8:18
WHEREAS, Arcadia Building Company, the developer of the Tavistock Farms
development, has not completed all the required public improvements in accordance with the
approved construction drawings and town standards with the two-year period agreed to in the
contract for public improvements and previously approved time extensions; and
WHEREAS, the developer has requested a one (1) year time extension to complete the
public improvements; and
WHEREAS, corporate surety bonds from the American Insurance Company in the
following amounts were provided by the developer to guarantee the installation of public
improvements in the Tavistock Farms deVelopment:
Tavistock Farms Section 9 -
Tavistock Farms Section 10 -
Tavistock Farms Section 11 & 12-
Tavistock Farms Section 13,19,20&21) -
Tavistock Farms Section 14 -
Tavistock Farms Section 18 -
Offsite Waterline -

WHEREAS, the town's Director of Engineering and Public Works has reviewed the
public improvements installed to date in Tavistock Farms Sections 10, 14 & 18 and certified that

(13,19,20&21), 14, 18, & OFFSITE WATERLINE AND MAKING A
REDUCTION OF THE PERFORMANCE GUARANTEE FOR
TAVISTOCK FARMS SECTIONS 10, 14 & 18
the value of work performed in Tavistock Farms Section 10 is $652,862.70, for Tavistock Farms
Section 14 is $131,073.00 and Tavistock Farms Section 18 is $73,590.00; and
WHEREAS, the Director of Engineering and Public Works recommends approval of one
(1) year time extensions for Tavistock Farms Sections 9, 10, (ll&12, (13,19,20&21), 14, 18; and
WHEREAS, the Director of Engineering and Public Works recommends approval of a
one (1) year time extension for the Offsite Waterline but with the condition that this be the final
time extension granted for the Offsite Waterline; and
WHEREAS, the Director of Engineering and Public Works recommends approval of a
bond reduction for Section 10, 14, and 18.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The corporate surety bonds from the American Insurance Company for the
amounts listed above are approved to guarantee the installation of public improvements in the
Tavistock Farms development.
The corporate surety bonds from the American Insurance Company are

reduced as follows:
Tavistock Farms Section 10 - $725,403.00 is reduced to $72,540.30
Tavistock Farms Section 14 - $230,879.00 is reduced to $99,806.00
Tavistock Farms Section 18 - $356,004.00 is reduced to $282,414.00

REDUCTION OF THE PERFORMANCE GUARANTEE FOR
TAVISTOCK FARMS SECTIONS 10, 14 & 18
SECTION 1II. The Town Manager shall notify the developer that liability for corporate
surety bond funds has been reduced as outlined in Section II of this resolution and that this
reduction does not constitute acceptance of public improvements by the town or relieve the
developer of responsibilities outlined in the contract for public improvements for Tavistock
Farms Sections 10, 14, and 18.
SECTION VI. One (1) year time extensions to October 23, 2000 for completion of the
public improvements is approved for Tavistock Farms Section 9, 10, (1 l&12), (13, 19, 20 & 21),
14, 18 and offsite waterline. This is the final time extension for the offsite waterline.
