Bal Harbour Village Hall • 655 - 96th Street • Bal Harbour • Florida 33154 CALL TO ORDER/ PLEDGE OF ALLEGIANCE — Following the General Employees' Retirement Board Meeting, Mayor Groisman called the meeting to order at 7:11 PM. Danie, Village Clerk Robert Meyers, Deputy Village Attorney The Pledge of Allegiance was led by Mayor Groisman at the beginning of the General Employee's Retirement Board Meeting. REQUESTS FOR ADDITIONS, WITHDRAWALS AND DEFERRALS There were no requests. R7 - RESOLUTIONS R7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA, ADOPTING THE PROPOSED MILLAGE RATE OF THE VILLAGE FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2018 THROUGH SEPTEMBER 30, 2019, PURSUANT TO SECTION 200.065, FLORIDA STATUTES; PROVIDING FOR CONFLICTS;PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item and provided a brief PowerPoint presentation. He recommended keeping the current millage as it has been for the last several years (1.9654 mils), 4.5% lower than it was in 2014 and the third lowest in Miami -Dade County, with a total revenue of $24,683,000 and a proposed budget of $16,079,700. He described proposed capital improvements, resort tax funds and expected expenditures for tourism & marketing, beautification, and special event activities. He then described the water and sewer revenues, recommending a lower water rate for the coming Fiscal Year. He then read the State required statement regarding the millage rate at 1.9654 mils with a State defined roll -back rate 1.9382 mils. There were no comments from the public. MOTION: A Motion to approve the Resolution was moved by Councilman Jeffrey Freimark and seconded by Assistant Mayor Seth Salver. VOTE: The Motion passed by unanimous voice vote (5-0). R7B A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR, VILLAGE, FLORIDA, APPROVING AND ADOPTING THE TENTATIVE BUDGET AND CAPITAL IMPROVEMENT PLAN FOR BAL HARBOUR VILLAGE FOR FISCAL YEAR 2018-19; PROVIDING FOR EXPENDITURE OF FUNDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Groisman described the proceedings for the rest of the Agenda and then commended Village Staff for the production of the Budget Book. He expressed his desire to bring all needed capital projects to fruition to make the Village look as good as the book. Councilwoman Cohen expressed her thanks to the Budget Committee stating that it would be nice to have them present to be recognized. She then asked the Council to reconsider utilizing the dollars allocated for New Year's Eve and apply them to the Fourth of July event. Mayor Groisman agreed. Ramiro Inguanzo (Assistant Village Manager) stated that the New Year's Eve event was important for the Hotels and recommended that the Council keep both firework displays. Mayor Groisman said that the majority of complaints he received was for a meager New Year's firework display and recommended that if we were going to be doing two shows, that we do both shows well, and if more dollars were needed, for staff to revisit the item with Council. Councilman Freimark stated that the Staff has a pretty good sense of the Council regarding the fireworks events, and also expressed his appreciation for the work undertaken by staff to complete the budget. Babak Raheb (128 Balfour Drive) commented that neighboring communities' New Year's Eve fireworks are better and that if the Village decided to continue with a display, that it should become an event, otherwise those dollars should be used for Fourth ofJuly. VOTE: The Motion passed by unanimous voice vote (5-0). R7C A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE COLLECTION AND DISPOSAL OF SOLID WASTE AND RECYCLABLE MATERIALS IN BAL HARBOUR VILLAGE, FLORIDA; DESCRIBING THE METHOD OF ASSESSING SOLID WASTE COSTS AGAINST ASSESSED PROPERTY LOCATED WITHIN BAL HARBOUR VILLAGE, FLORIDA; DETERMINING THE SOLID WASTE COST AND THE INITIAL SOLID WASTE SERVICE ASSESSMENTS; DIRECTING THE PREPARATION OF AN ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE THEREOF; AND PROVIDING AN EFFECTIVE DATE Mr. Gonzalez introduced the item saying that he had negotiated with the provider and that he was recommending the same rate as the previous year. Babak Raheb (128 Balfour Drive) commented that larger houses use more garbage and the calculations for the rates should be based on house size. Councilwoman Cohen stated that the Village should do more to encourage recycling, to which Mayor Groisman stated that information had been disseminated but a concerted effort would do more. Councilman Freimark agreed that the Village could set a better example, stating that other communities provide recycling receptacles. R7D A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE PROVISION OF SECURITY AND LANDSCAPE SERVICES, FACILITIES AND PROGRAMS IN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR VILLAGE, FLORIDA; ESTABLISHING THE RATE OF ASSESSMENT; IMPOSING SECURITY AND LANDSCAPE SERVICE ASSESSMENTS AGAINST ASSESSED PROPERTY LOCATED WITHIN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR VILLAGE, FLORIDA; APPROVING THE ASSESSMENT ROLL; CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; AND PROVIDING AN EFFECTIVE DATE Mr. Gonzalez introduced the item stating that the Village had entered into a Milestone Agreement with the Civic Association to proceed with an orderly transition of them maintaining their affairs, but in the meantime the Village had agreed to continue collection of the Security Assessment, and he Bal Harbour Village Council Budget Hearing Minutes — September 12, 2018 Page13 was recommending the same rates as the previous years. He said that an allocation of $45,000 from the fund balance allocation would offset expenditures. Tom Robertson (representing the Bal Harbour Civic Association) stated that under the Milestone Agreement, the Civic Association has been successful in obtaining a significant membership, with 132 of 194 single family homes, and 147 of 277 (adding in condominiums) having joined. He said that membership dollars had been reinvested into the security system. He added that the Civic Association has no later than 365 days from effective date (Jan. 31, 2019) of the agreement to have its first election. Babak Raheb (128 Balfour Drive) said that the bylaws of the previous association say that anybody who owns a property is automatically a member and that the Association has no authority to impose liability on its members. He said the Village had already collected his $2,600 assessment and now he was being asked to pay an additional $900 for membership into an association of which he is already a member. Mayor Groisman asked Mr. Robertson if the Civic Association was planning an election before the end of this year and if all residents, whether they had joined the association or not, would be noticed, and suggested that non-members should be given the opportunity to join. Mr. Robertson stated that no liability had been placed, that the Association, at this point, has no ability to assess or lien and that transitioning was a step-by-step process. Mr. Meyers read Section 3.14 of the Milestone Agreement regarding non-interference with the Association by the Village. MOTION: A Motion to approve the Resolution was moved by Councilman Jeffrey Freimark and seconded by Assistant Mayor Seth Salver. VOTE: The Motion passed by unanimous voice vote (5-0). R7E A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; AUTHORIZING RENEWAL OF THE VILLAGE'S GROUP HEALTH INSURANCE POLICY WITH FLORIDA BLUE; AUTHORIZING RENEWAL OF THE VILLAGES GROUP DENTAL POLICY WITH METLIFE; AND AUTHORIZING THE RENEWAL OF THE VILLAGES VISION POLICY WITH METLIFE; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR A RENEWAL OPTION UP TO TWO YEARS; AND PROVIDING FOR AN EFFECTIVE DATE. Bal Harbour Village Council Budget Hearing Minutes — September 12, 2018 Page 14 Mr. Gonzalez introduced the item, stating that for the second year in a row, the Village has been able to renew health, vision and dental with no increase in premiums and with the same level of benefits, and a modest increase (2.5%) in life insurance. MOTION: A Motion to approve the Resolution was moved by Councilman Jeffrey Freimark and seconded by Assistant Mayor Seth Salver. VOTE: The Motion passed by unanimous voice vote (5-0). Mayor Groisman expressed his appreciation for the Police Department for their presence and engagement with the community during the holidays. R9 - NEW BUSINESS AND COUNCIL DISCUSSION R9A - PUBLIC COMMENT Babak Raheb (128 Balfour Drive) stated that the Civic Association should first conduct an election then change their bylaws, and until they change the bylaws anybody who owns a property is automatically a member. He said that the Association is a private -for -profit organization and the Village cannot use its power to help a private organization.
