RESOLUTION NO. 2000-37 ADOPTED February 23, 2000
A RESOLUTION: APPROVING THE VACATION OF A WATER LINE EASEMENT ON THE
PROPERTY OF KINCAID FOREST SECTION 5, AND APPROVING THE
RELOCATION OF THE EASEMENT TO A NEW LOCATION ON THE
PROPERTY OF KINCAID FOREST SECTION 5.
WHEREAS, A WATER LINE EASEMENT on the property of Kincaid Forest Section 5, was
created to provide water service to the town house development known as Kincaid Forest Section 8; and
WHEREAS, The Jordan Co., has requested that The WATER LINE EASEMENT on the property
of Kincaid Forest Section 5, be vacated to eliminate a conflict with a proposed tennis court on the
proposed recreation center; and
WHEREAS, relocation of a small portion of the existing waterline easement on Kincaid Forest
Section 5 will not adversely impact the operation and maintenance of the water system located within the
Kincaid Forest Subdivision.
THEREFORE RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. That portion of the water line easement labeled as "15' Water Hereby Vacated" as
shown on the plat of easement and vacation titled "FINAL PLAT WATERLINE EASEMENTS
(EXISTING, PROPOSED AND VACATED) FOR KINCAID FOREST SECTION 5, PARCEL "A' ,
TOWN OF LEESBURG, LOUDOUN COUNTY , VIRGINIA" dated 08-11-1999 and prepared by
Central Maryland surveyors, Inc. is hereby vacated.
SECTION II. That portion of the water line easement labeled as "15' Water E'smt' as shown on
the plat of easement and vacation titled "FINAL PLAT WATERLINE EASEMENTS (EXISTING,
PROPOSED AND VACATED) FOR KINCAID FOREST SECTION 5, PARCEL "A" , TOWN OF
LEESBURG, LOUDOUN COUNTY, VIRGINIA" dated 08-11-1999 and prepared by Central Maryland
surveyors, Inc. is hereby accepted.

SECTION III. This resolution shall be in effect upon the recordation of the Deed of Vacation
and Easement in a form approved by the Town Attorney with the above referenced Plat of Easement and
Vacation.
