CODE, 2002 NATIONAL ELECTRICAL CODE, 2003 INTERNATIONAL PLUMBING
CODE, 2003 INTERNATIONAL FUEL GAS CODE, 2003 INTERNATIONAL ENERGY
CONSERVATION CODE, 2003 INTERNATIONAL FIRE CODE, AND A117.1-1998.
An ordinance of the governing body of the City of Moab adopting the 2003 International
Building Code, 2003 International Residential Code, 2003 International Mechanical
Code, 2002 National Electrical Code, 2003 International Plumbing Code, 2003
International Fuel Gas Code, 2003 International Energy Conservation Code, 2003
International Fire Code, and A117.1-1998, regulating the erection, construction,
enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy,
equipment, use, height, area and maintenance of all buildings or structures in the
incorporated areas of Grand County, Utah providing for the issuance of permits,
providing for penalties for the violation thereof, repealing all other ordinances and parts
of the ordinances in conflict therewith.
The Moab City Council does ordain as follows:
Section 1. That certain documents, three (3) copies of which are on file and are open for
inspection of the public in the office of the Grand County Building Official being marked
and designated as:
The 2003 International Building Code, 2003 International Residential Code, 2003
International Plumbing Code, 2003 International Fuel Gas Code, 2003
International Energy Conservation Code, 2003 International Fire Code, published
by International Code Council Inc., 2002 National Electrical Code, published by
National Fire Protection Association, and the American National Standards for
Accessibility and Useable Buildings and Facilities, A117.1 published by the
Council of American Building Officials as modified by the 2003 International
Building Code referenced herein:
be and the same are hereby adopted as the code of City of Moab, Utah for
regulating the erection, construction, enlargement, alteration, repair, moving,
removal, demolition, conversion, occupancy, equipment, use, height, area and
maintenance of all buildings or structures in City of Moab providing for issuance
of permits and collection of fees therefore;
Section 2. A violation of any provision of any provision of this ordinance is a class B
misdemeanor, unless otherwise provided.
Section 3. That all other ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance
is, for any reason, held to be invalid or unconstitutional, such decision shall not affect
the validity or constitutionality of the remaining portions of this ordinance. The Moab City
Council hereby declares that it would have passed this ordinance, and each section,

subsection, clause or phrase hereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared unconstitutional.
This ordinance shall take effect immediately upon passage.

AN ORDINANCE AMENDING FER
13.25 OF THE MOAB MUNICIPAL CODE
REGARDING WATER AND SEWER IMPACT
FEES
WHEREAS, the Utah Impact Fee Act man-
dates that municipalities establish ordinances and
procedures for the equitable apportionment of
costs for municipal capital improvements; and
WHEREAS, the City has adopted an impact
fee ordinance providing for standard water and
sewer impact fees; and
WHEREAS, development in the area north of
Moab city limits necessitates the construction of
a water line with sufficient capacity to meet build
out projections for the area (North Area Water-
line South Loop); and
WHEREAS, a property owner has agreed to
pay for all costs associated with the construction
and installation of the North Area Waterline South
Loop subject to a cost reimbursement agreement
whereby the City collects impact fees from fu-
ture connections to said line and reimburses said
property owner for the cost of the North Area
Waterline South Loop; and
WHEREAS, an impact fee for the North Area
Waterline South Loop is needed to ensure equi-
table apportionment of the cost of the waterline;
NOW, THEREFORE, WE, THE GOVERNING
BODY OF THE CITY OF MOAB HEREBY
AMEND CHAPTER 13.25 13.25,030, AS FOL-
LOWS:
Section C shall be added to Section 13.35.030
Service Areas, to read as follows:
C. The Service area for the North Area Wa-
terline South Loop impact fee shall include prop-
erties connecting to the North Area Waterline
South Loop. Existing customers with city water
service prior to the adoption of this fee that con-
nect to the North Area Waterline South Loop will
not be required to pay this impact fee except to
the extent that such a customer increases their
peak instantaneous demand after the adoption
of this fee.
Section D shall be added to Section 1325.060
Calculation of Impact Fees, to read as follows:
D. Water Impact Fees for properties connect-
ing to the North Area Waterline South Loop shall
be as follows:

This fee shall remain in effect until 10 (ten)
years after adoption.
Peak instantaneous demand shall be calcu-
lated using State of Utah Administrative Rules
for Public Drinking Water Systems.
This ordinance shall take effect immediately
upon passage.
Passed and adopted by action of the Gov-
erning Body of the City of Moab in open session
this 9dday of March, 2004.
