AUTHORIZING A 120-DAY LEASE EXTENSION WITH
LOUDOUN ANTIQUES MARKETPLACE AT THE IZAAK
WALTON PARK SITE
WHEREAS, in December 1999, the Town Council approved a long-term lease
agreement with Failmezger Investments to lease approximately 21 acres of land, known
as the Izaak Walton park site, for use as a public park; and
WHEREAS, the town's lease becomes effective on July 1, 2000; and
WHEREAS, currently Loudoun Antiques Marketplace leases the building on the
property from Failmezger Investments; and
WHEREAS, Loudoun Antiques Marketplace requested a 90-120 day extension of
their lease due to difficulty locating an available site by July 1, 2000; 'and
WHEREAS, Loudoun Antiques Marketplace is willing to lease the building from
the Town of Leesburg under the same terms and will cooperate with the town regarding
building inspections and related work; and
WHEREAS, the current lease agreement between the Town of Leesburg and
Failmezger family does not permit sub-leasing of the property; and
WHEREAS, the representative of the Failmezger family has agreed to amend the
lease to permit a 120 lease extension between the Town of Leesburg and Loudoun
Antiques Marketplace; and
WHEREAS, the Director of Parks and Recreation recommends approval of the
120-day lease extension with Loudoun Antiques Marketplace.

THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia
as follows:
SECTION I. The Town Manager is hereby authorized to enter into a 120-day
lease extension agreement with Loudoun Antiques Marketplace under the current lease
terms between Loudoun Antiques Marketplace and the Failmezger family.
SECTION II. The 120-day lease extension shall commence on July 1, 2000 and
terminate on October 28, 2000.
SECTION III. The lease extension agreement will require Loudoun Antiques
Marketplace to pay $2,200 per month, excluding utilities to the Town of Leesburg.
SECTION IV. The lease extension agreement between the Town of Leesburg and
Loudoun Antiques Marketplace is subject to approval by the Town Attorney.
