INITIATION:
1, Mayor Harker called the regular meeting of the City Council to
2. order at 7:30 P. M. Rev. Dennis Savage of the Christian Church of
3. Temple City gave the invocation followed by the Pledge of Alleg-
iance to the Flag led by the Mayor.

5. APPROVAL OF MINUTES: Regular meetinr.; of Jan. 4, 1966.
Councilman Merritt moved to approve the minutes of the regular
meeting of the City Council of Jan. 4, 1966, as mailed, Councilman
Nunamaker seconded and the motion was unanimously carried.
UNFINISHED BUSINESS:
6. ORDINANCE NO. 66 --180: 2nd read. Re Drainage of Lots in Subdivi-
sion and Lot Splits.
City Attorney Martin stated the County Drainage Engineer had re-
quested this amendment to the ordinance the City adopted six mont`r ::;

PUBLIC HEARING, CONTD.: 7:30 P. M. ASSESSMENT HEARING PARKING D I STR I C
NO. 3.
City Attorney Martin advised this was a continuation of the public
hearing cf Jan. 4, 1966, re the spreading of the assessments for

Engineer to prepare an alternate plan of assessments to be presen :.-
ed to the Council at this time. City Attorney Martin at this tiire
swore in Engineer Krolle.
Attorney Kramer of O'Melveny & Myers, requested Engineer Krelle to
explain and review again the recommended changes made by the Coun-
cil at the last meeting and to ser:rarize the chinees as he has
made them.
Engineer Krelle stated the Council instructed him to modify the

Engineer Krelle also presented an alternate spread as follows:

Councilman Dickason stated he would favor the alternate method
as stated by the Engineer. Councilman Tyrell felt a determina-
tion should be made as to what if any value was received by the
lots above #9. Councilman Nunamaker stated they had signed to
come into the District and Engineer Krelle advised the proposed
assessments were within 5% of the estimated essessments on the
original proposal, and the assessments now proposed were arrived
at in the same manner. Following further discussion by the
Councilmen, Mayor Harker asked if anyone wished to be heard From
the audience.
Paul Boatright, 5924 Temple City Blvd., stated the property own-
ers on Temple City Blvd. already have 28 parking spaces. His
property is two lots from the parking district and he feels it
is of no benefit to him and h; dad not sign the petition for the
formation of the district.
Kelley Lookabaugh, 5926 Temple City Blvd., stated they did sign
the petition but they do not believe the method of assessment is
fair, and if it were there would be complaints from Las Tunas Dr.,
and there is none while on Temple City Blvd. everybody is com-
plaining. Also the property acquisition in the district cost
$55,000. and $2000. for the black top and they wished to know
what the additional $16,000. for the district was for. He ad-
vised an attorney from El Monte was representing them and he
could not come up with an answer for this amount.
The City Manager advised he had talked at length over the tele-
phone with their attorney and asked him if he wanted an appoint-
ment to come in and go over this which he did not do. He also
stated the property owner on the extreme easterly property was
not happy with their proposed assessment but they can foresee
the future and what it means to the entire commercial block.
They have 100 ft. of frontage and their assessment is $10,800.,
and they also are furnishing two parking lots now.
Chas. Mahaffey, 5934 Temple City Blvd., stated he was for the
parking lot but was in favor of the method proposed by Council-
man Merritt for assessing the properties on Temple City Blvd.
Councilman Tyrell asked the City Manager if the Las Tunas prop-
erties had waived the rights of ingress and egress if any and
was advised not as yet. Councilman Tyrell fe'; t that we should
have these releases before sil-re id n; the assessments

PUBLIC HEARING: 7:30 P. M. CURB & GUTTER ASSESSMENT: 9221 Pentland
Councilman Nunamaker moved to open the public hearing, seconded
and carried. The City Manager advised the installation has been
made and completed in this area which is the north side of
Pentland between Alessandro and Encinita, and all payments have
been made except 9221 Pentland, and he recommended an assessment
of $137.50 be filed against the property which represents a
55 ft. frontage at $2.50 per ft.
Mayor Harker asked if anyone in the audience wished to speak for
or against this assessment and no one came forward to speak.
Councilman Tyrell moved to close the public hearing, Councilman
Merritt seconded, and the motion was unanimously carried. Coun-
cilman Tyrell moved to approve the assessment and direct that th
property be so assessed, Councilman Dickason seconded, and the
motion was carried unanimously.
PUBLIC HEARING: 7:30 P. M. FORMATION HEARING: GREEN ST. SEWERS
Councilman Nunamaker moved to open the public hearing, seconded
and carried.
Robert Moller, City Engineer, advised this was a hearing on a
resolution of intention to start a sewer improvement district on
Green St., known as Temple City Improvement #/4.
City Manager Koski stated the map of the proposed district was
posted on the display board, and presented affidavits of publica-
tion, posting of notices, recordation, and mailing of notices.
Councilman Tyrell moved to accept these affidavits, Councilman
Merritt seconded, and the motion carried unanimously.
City ManagerYoski advised the Council that no written protests
had been received.
Mayor Harker asked if anyone wished to speak against the formatic .
of this district and no one came forward to speak.
The Mayor then asked if anyone wished to speak in favor of the
formation of the district and no one came forward to speak.
The City Attorney requested Engineer Moller to state his exper-
ience for the record.
Engineer Moller stated he was the Regional Engineer under the
County Engineer, that he was familiar with the plans and speci-
fications, all oF the district is within the boundaries oF Tempi::
City and all these properties are within the district, the bene-
fit would be having a sewer available to the properties that are
now on private disposal systems. The estimated cost is $18,650;
and the benefits would be commensurate to that cost.
Councilman Nunamaker moved to close the public hearing, seconded
and unanimously carried.
Engineer Molle stated the Council should first adopt the pre-
vailing wage scales, and then adopt a Resolution instituting the
action and putting out the notice inviting bids.
Councilman Tyrell moved to approve the prevailing wage scale,
Councilman Nunamaker seconded, and the motion carried unanimously
City Attorney Martin read title to Resolution No. 66 -567 TEMPLE
CITY IMPROVEMENT NO. 4 GREEN STREET FOR THE ACQUISITION AND
NECESSARY RIGHTS OF WAY AND THE CONSTRUCTION OF SANITARY SEWERS,
A RESOLUTION ORDERING ACQUISITION AND IMPROVEMENT AND DETERMINING
LIQUIDATED DAMAGES. Councilman Tyrell moved to adopt Resolution
No. 66 -567, Councilman Nunamaker seconded, roll call vote to carr
as follows:

NOES: Councilmen -None

PUBLIC HEARING: 7:30 P. M. PROPOSED ANNEXATION #10
City Attorney Martin advised this public hearing is a regular
routine procedure to see whether sufficient protests are receive(:
to determine whether the Council should call a special election
in the territory to be annexed to determine whether they wish to
annex or not annex.
Councilman Tyrell moved to open the public hearing, Councilman
Nunamaker seconded, and the motion carried unanimously.
City Manager Koski advised no written protests have been receive.

proposed annexation.
Mr. Al Fishback, 5368 N. Muscatel, stating he was protesting as
he had lived there 25 yrs. and he liked it just the way it is.

City Attorney Martin read title to Resolution No. 66 -568 A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY FINDING
NO MAJORITY PROTEST IN RE ANNEXATION NO. 10. Councilman Tyrell
moved to adopt R.solution No. 66 -568, Councilman Nunamaker se-
conded, roll call vote to carry the motion as follows:

City Attorney Martin read title to Resolution No. 66 -569 A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY CALLING
A SPECIAL ELECTION TO BE HELD ON THE 22ND DAY OF MARCH, 1966,
PERTAINING TO THE ANNEXATION OF "ANNEXATION NO. 10" TO THE CITY
OF TEMPLE CITY. Councilman Nunamaker moved to adopt Resolution
No. 66 -569, Councilman Merritt seconded, and the motion was
unanimously carried.
City Attorney Martin announced to the audience that on March 22,
1966, that there will be an election at which time if the major-
ity want to come into the City the area will be annexec, and if
the majority want to stay out they will stay out.
7. APPEAL FROM PLANNING COMMISSION DECISION VARIANCE CASE #65-173,
Rudy Strnad, 9738 Las Tunas Dr.
Planning Director Cushman advised this request was for a quick
stop type of market proposed on the southwest corner of Las Tunas
and Golden West and the variance request was because they lacked
the required number of parking spaces as shown in the zoning
ordinance. For this reason the variance was denied by the Plan-
ning Commission and the Council at its last meeting decided to
review the case based on the record of the Planning Commission.
Also a letter received from the applicant requests you not to
arrive at a decision on that basis but co to a de novo nearing.
Following discussion Councilman Tyrell moved to set a public
hearing for Febr. 1, 1966, at 7:30 P. M., Councilman Dickason
seconded, and the motion carried unanimously,
3, RESOLUTION NO. 66 -554: re additional law enforcement services
during racing season.
City Manager Koski presented Resolution No. 66 -554 A RESOLUTION
OF THE CITY OF TEMPLE CITY REQUESTING ADDITIONAL LAW ENFORCEMENT
SERVICES WITHIN THE CITY OF TEMPLE CITY, CALIFORNIA, FROM THE
LOS ANGELES COUNTY SHERIFF'S DEPARTMENT UNDER THE LAW ENFORCEMENT
AGREEMENT. Councilman Tyrell moved to adopt Resolution No. 66-
554, Councilman Merritt seconded, and the motion carried unani-
mously.
NEW BUSINESS:
9, RESOLUTION NO. 66 -563: Calling & Giving Notice of General Munici-
pal Election on April 12, 1966.
The Chief Deputy City Clerk presented Resolution No. 66 -563
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL
MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 12TH
OF APRIL, 1966, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY
AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIF-
ORNIA RELATING TO GENERAL LAW CITIES. Councilman Dickason moved
to adopt Resolution No. 66 -563, Councilman Merritt seconded, and
the motion carried unanimously.
10. RESOLUTION NO. 66 -564: requesting Registrar of Voters for speci-
fied services for the General Municipal Election.
The Chief Deputy City Clerk presented Resolution No. 66 -564
A RESOLUTION OF THE. CITY COUNCIL OF THE CITY OF TEMPLE CITY RE-
QUESTING THE BOARD OF SUPERVISORS CF THE COUNTY OF LOS ANGELES TO
PERMIT THE REGISTRAR OF VOTERS or SAID COUNTY TO RENDER SPECIFIED
SERVICES TO THE CITY OF TEMPLE C b TY , RELATING TO THE CONDUCT OF
A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 12,
1966. Councilman Tyrell moved to adopt Resolution No. 66 -564,
Councilman Nunamaker seconded, the motion was unanimously
carried.
The City Attorney advised the Council there was a point on this
election the Council will have to determine, A law change permit
all candidates to 1-ile a qualification sheet with the City Clerk
to be correlated with others filed into a brochure to be mailed
with the sample ballots, The law provides a charge can be made
for this service and a deposit c =:,n be required in advance, It

has been estimated the cost per nominee would be in th ilta of
$100., the exact amount cannot be determined as yetb tt is re-
commended a $100. deposit be made by those requiring this service,
Councilman Tyrell moved to set the deposit at $100., Councilman
Merritt seconded, and the motion carried unanimously.
The City Attorney advised law changes also permits the City Clerk
to canvass the results of the election. Councilman Tyrell moved
to instruct the City Attorney to prepare such a resolution,
Councilman Nunamaker seconded, and the motion carried unanimously,;
11. RESOLUTION NO. 66 -565: appointing a Planning Director
The City Manager presented Resolution No. 66 -565 A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING GEORGE
DRAGICEVICH DIRECTOR OF PLANNING. Following discussion Council-
man Tyrell moved to adopt Resolution No. 66 -565, Councilman
Merritt seconded, and the motion carried unanimously.
12. PLANNING COMMISSION RECOMMENDATIONS: re building permits for
gasoline service stations etc.
Planning Director Cushman advised the Planning Commission have se
For public hearing certain amendments to the city zoning ordinanc
with regulations of service stations and other drive -in
businesses, and they also adopted a Resolution urging the City
Council to adopt an urgency ordinance that no permits be issued
during a 90 day period.
The City Attorney advised he had prepared an Ordinance as follows
ORDINANCE NO. 66 -133 AN ORDINANCE OF THE CITY OF TEMPLE CITY EN-
ACTING AN INTERIM ZONING ORDINANCE PURSUANT TO THE PROVISIONS OF
SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE IMPOSING A MORA-
TORIUM ON BUILDING PERMITS FOR GASOLINE STATIONS AND OTHER DRIVE -
IN BUSINESSES PENDING PLANNING COMMISSION STUDIES WITH RESPECT
THERETO. He recommended adopticn as an urgency ordinance.
Councilman Tyrell moved to waive further reading of Ordinance
No. 66 -133, Councilman Nunamaker seconded, and the motion was
carried unanimously. Councilman Nunamaker moved to adopt Ordi-
nance No. 66 -133 as an urgency ordinance, Councilman Tyrell se-
conded, and the motion carried unanimously.
13. PARKING COMMISSION RECOMMENDATIONS: modification of parking res-
trictions on off-street public parking lots.
The City Manager advised the Commission recommended removal of
the 2 hr. restriction on the off- street parking lots and replace
it with a 4 hr. restriction and to be cited on complaint only
and the fee to be $5.00. Following discussion Councilman Tyrell
moved to set the parking restriction on the off - street parking
lots to 4 hrs. and let the Court set the Fine, Councilman Merritt
seconded, and the motion was unanimously carried. It was stated
that on Febr. 10 a meeting was scheduled For the business owners
and the Commission for suggestions and to have them control em-
ployee parking.
14. RESOLUTION NO. 66 -566: qarrants & Demands
City Manager Koski presented Resolution No. 66 -566 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS ANL
DEMANDS IN THE SUM OF $18,131.70, DEMAND NOS. 7521 THROUGH 7557.
Councilman Tyrell moved to adopt Resolution No. 66 -566, Council-
man Nunamaker seconded, roll call vote to carry as follows:
AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker
NOES: Councilmen -None
ABSENT: Councilmen -None
15. COMMUNICATIONS:
The City Manager presented a petition received signed by 40 prop-
erty owners and tenants in the neighborhood of Rancho Real, Olive,
Broadway & Sultana, protesting the excessive noise caused by dogs
at the Temple City Animal Hospital. The City Attorney advised
this was being investigated by the City Manager and with the
possibility of future actions b`y the City Council he recommended
they have no further discussion or take no action before a deter-
mination is made. The research has not been completed as to what
type of hearing should be held bug there certainly will be a
hearing scheduled. Councilman Tyrell moved to continue until the
next meeting on Febr. 1, at 7 :30 P. M. for recommendations at
that time, Councilman Nunamaker seconded, and the motion was
unanimously carried.

Councilman Merritt asked about El Monte Ave. refering to the
paving and the City Manager advised this project is under the
County Sanitation District and it will be reconstructed.
Councilman Nunamaker asked about the left turning of the busses
from the track on Temple City Blvd. The City Manager advised
he had been in touch with the officers of the Track and the
Sheriffs Dept. The Track officers have been trying to work out
something with the M. T. A. for the past week for an alternate
route. He made the recommendation that if he is not successful
in obtaining the cooperation by Monday, Jan. 23, that he be
authorized to post "No Left Turn" signs at the Las Tunas - Temple
City intersection. Councilman Nunamaker so moved, Councilman
Tyrell seconded, and the motion carried unanimously.
Councilman Tyrell asked about Ordinance No. 66 -178 and was ad-
vised by the Planning Director that the Planning Commission had
just received this ordinance on Jan. 11 and had it under study.
Councilman Dickason recommended any action on the ordinance be
delayed until the recommendations were received from the Planning
Commission. Councilman Tyrell stated he did not see how the
Planning Commission could improve on it and that there should be
a first reading. City Attorney Martin read title to Ordinance
No. 66 -178 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE
ZONING CODE OF THIS CITY BY THE ADDITION OF NEW ARTICLE 20 A
SECTIONS 2350 - 2363 RELATING TO PROPERTY NUISANCES. Councilman
Tyrell moved to waive further reading of Ordinance No. 66 -173,
Councilman Nunamaker seconded, roll call vote as follows:
AYES: Councilmen - Merritt, Nunamaker, Tyrell
NOES: Councilmen - Dickason, Harker
ABSENT: Councilmen -None
This required the City Attorney to read the Ordinance in full and
he recommended the Council move that reading in full be waived.
Councilman Tyrell so moved, Councilman Nunamaker seconded, and th;
motion carried unanimously. Councilman Tyrell then moved to
place Ordinance No. 66 -178 on first reading, Councilman Nunamaker
seconded, and the motion carried by the Following roll call vote-

The City Attorney stated that in placing on first reading this
would expedite future action and the recommendations from the
Planning Commission can still be heard before a second reading
made.
In connection with the widening of Baldwin Ave. the City Attorney
requested authorization of a warrant to the County Clerk in
the amount of $155,251.00, the amount of the appraisal reports or
acquisitions required on 39 parcels, all partial takings. This
will expedite whatever action is necessary to get the improvement..
started. Councilman Tyrell so moved, Councilman Merritt seconder.:

Councilman Nunamaker moved to authorize offering the appraised
valuation to the property owners on Baldwin Ave., Councilman
Tyrell seconded and the motion carried unanimously.

17. MATTERS FROM CITY OFFICIALS:

The City Manager advised this was provided as preliminary plans
which you requested the Engineer to provide for you to look at
improvements, and this will be con= ..idered at the next study ses-
sion.
City Manager Koski requested authorization for a warrant in the
amount of $7.72 for the Board of Equalization for the annual
return for sales tax collected. Councilman Tyrell moved to ap-
prove, Councilman Nunamaker seconded, and the motion was carried
unanimously,

City Manager Koski stated there would be a:'Management Seminar
on Jan. 27th and 28th in Long Beach at a cost of $25. which he
felt would be very beneficial to him and requested authorization
:o,attend. Councilman Merritt moved to approve, Councilman
D1ckason seconded, the motion carried unanimously.
The City Manager advised Mr. Langley of So. Calif. Edison Co.
was retiring and recommended he be awarded a certificate of re-
cognition from Temple City for his long and fine service to this
City. He advised it was through the efforts of Mr. Langley that
we were able to proceed with the underground work in our busines:>
district. Following discussion this was approved by the Council,
The City Manager presented a letter from Krelle & Lewis concern-
ing the work on Double Dr. recommending a partial payment to
Dukes Landscape for services as of Jan. 7 in the amount of
$5,683.50, and the City Manager recommended a warrant be author-
ized. Councilman Tyrell felt the work should be completed and
all paid at that time. Following discussion Councilman Dickason
moved to approve the partial payment of $5683.50, Councilman
Merritt seconded, roll call vote to carry as follows:

City Manager Koski presented a recommendation from Krelle & Lewis
for a payment of $1791.05 for temporary resurfacing of the lots
in Parking Dist. #1 and Parking Dist. #3. Following discussion
Councilman Nunamaker moved to approve the payment, Councilman
Merritt seconded, carried by the following roll call vote:
AYES: Councilmen- Dickason, Merritt, Nunamaker, Harker
NOES: Councilman - Tyrell
ABSENT: Councilmen -None
The City Manager advised there will be a Streets & Highways Con-
ference Jan. 27 and 28 and the request is to send George Envall
our Traffic Engineer. The cost is estimated to be $70. and So.
El Monte will pay one -half so the expense to the City would be
$35. Following discussion Councilman Merritt moved to approve,
Councilman Nunamaker seconded and the motion carried unanimously,
The City Manager requested Maurice Cornelison to come forward
and be sworn in as a Parks & Recreation Commissioner, and proceed
ed to give him the oath of office.
18, ADJOURNMENT: Councilman Tyrell moved to adjourn, Councilman
Nunamaker seconded, and the motion carried. Council adjourned
at 10:05 P. M. The next regular meeting of the City Council will
be on Febr. 1, 1966 in the Council Chambers of the City Hall,
5938 Kauffman Ave., Temple City.
