Present: Mayor, Gary Acromite; Councilmembers, Wilfred Scherer, Ann Thies, Robert Mitchell, Philip Zietlow; Clerk -Treasurer, Donna Roehl; Public Works Director, James Dillman; Zoning Administrator, Loren Kohnen; Police Chief, Richard Rabenort; Attorney, Ron Batty 1. ADDITIONAL AGENDA ITEMS Moved by Mitchell, seconded by Zietlow, to discuss the following additional items: Street of Dreams Focus grougs Hunter Farms Park Remove liquor license approval from consent agenda Motion declared carried 2. MINUTES OF MAY 30, 1991 Moved by Thies, seconded by Acromite to approve minutes of May 30, 1991, as presented. Motion declared carried 3. MINUTES OF JUNE 4, 1991 Ann Thies stated that Item 7, Page 78 be corrected. "Host" city should be part of the motion. Gary Acromite stated that second to motion for Item 6, Page 78 should be seconded by councilmember Scherer. Moved by Thies, seconded by Acromite to approve minutes of June 4, 1991, as corrected. Motion declared carried. 4. BUSINESS COMMUNITY REPRESENTATIVE Gary Acromite reported that the Northwest SuburLan Chamber of Commerce has formed a committee of business representatives that will be meeting from 5:00 p.m. to 6:00 p.m. on Wednesdays following the first city council meeting to discuss pertinent issues with the mayor and/or one other councilmember. Also at the second council meeting of each month one of their representatives will le present to discuss issues. Regg Pederson, chairman of the group, stated that this will be an opportunity for business owners who do not live in Medina, to express opinions on various issues. 5. HOUSING REHABILITATION Council discussed letters from Hennepin County and from attorney, Jim McKinnon, regarding status of I-ou. e at 2835 Ardmore Ave. Robert Mitchell was concerned about the condition of the souse and a need to have it removed from the property sometime in July. Barhara Hayden of Hennepin County Planning and development, stated that if the city approves reprogramming of Community Development Block grant funds into the rehab pro- gram it should also ask that as an alternative to rehabilitation of the existing house funds should be used to move a house onto the property. She stated that the homeowner would need additional funds before the county would commit to the project. Philip Zietlow asked that a letter be written to Jim McKinnon explaining the need to have the existing house removed from the property by the end of July. Moved by Mitchell, seconded by Thies to table the matter until July 2, 1991. Motion declared carried 6. 1991-1992 LIQUOR LICENSES Ron Batty explained that the city had agreed that golf courses cr.uld sell beer on the course until July 1st and that the council was to consider extending; that approval when licenses Caere renewed for 1991--1992. He explained that he had called some cities and found that none of the cities had language in their ordinance regarding sale of liquor on a golf course. He stated that some cities allow sales, some don't, and some do not regulate. He reported that the liquor control commission believes that sales on a golf course are contrary to state statutes. He suggested that the city allow sales through the license, not through an ordinance amendment, if council wishes to allow continuance of the sale. Robert Mitchell stated that conflicting information had been received from golf course repro.`rtatives, at t a June 4th meeting, regarding sales. Bob Wicklund of Hennepin Parks, stated that they had gotten their information from the golf courses and the city attorney had called city offices. Ken Gullickson of Rolling Green Country Club stated that they had also called golf courses. Robert Mitchell stated that there is a supervision problem and insurance companies should be asked if they insure the entire golf course if beer is sold or consumed. Gary Acromite stated that it is important that the city is consistent with state laws. He asked if licenses could be amended later if information is received that proves that it is all right to serve beer on a golf course. Robert Mitchell stated that this is not only a question of selling on a golf course but one of consumption as well. He suggested that the clubs secure copies of other club licenses to determine if the entire golf course is included in the licenses premises. PUBLIC WORKS DEPARTMENT * U.S. West Moved by Mitchell, seconded by Thies to adopt Resolution 91-36, allowing U.S. West to install a manhole and conduit system on Pinto dr., south of Hwy. 55. Motion declared carried Independence Estates/Dan Bar Homes Jim Dillman reported that there is a drainage problem at Independence Estates and that he had met with developer, Dan Bartas, to review the correction that needs to be made. He stated that the city has $4000 in escrow from Dan Bartas, that could be used to install another catch -basin, if the developer fails to complete the work. Moved by Mitchell, seconded by Zietlow to notify Dan BArtas that the drainage problem at Independence Estates must be corrected according to the development contract, city staff and residents satisfaction, by July 1st, or the city will do the work using the escrow funds. Jim Dillman stated that there are two vacant lots that also need grading corrections. Robert Mitchell amended his motion to include a requirement that correct elevations are maintained on undeveloped lots, with address files to include elevation information. Amended motion was seconded by Philip Zietlow. Motion declared carried Independence Beach Water Treatment Jim Dillman reported that water treatment at Independence beach can not be done as cheaply as originally believed and that individual home filters may not be sufficient. He stated that a system for the entire area could cost from $16,000 to $230,000 and council should - decide if further investigation should be conducted. Philip Zietlow stated that water bills are high and that there is a responsibility to residents to solve the problem. Moved by Mitchell, seconded by Acromite to direct staff to continue a study of treatment alternatives and to prepare a letter of explanation to be sent tor esidents. Motion declared carried 84 Storm Sirens Jim Dillman stated that there is one com_aany that services storm sirens service monthly fee of $24, per month, per siren, or a base fee of $150 to pay for all later maintenance. Moved by Zietlow, seconded by scherer to enter into agreement for storm $24 per month for each of the three sirens. Motion declared carried at either a full each with the city siren service at 8. OFFICIAL NEWSPAPER Ann Thies reviewed report on Official newspapers, that was done by Rose Epple, Nancy Edwards and Rick Zeller. She thanked them for the work they had done. Council discussed recommendations that were made, including reducstiny that a Crow River News reporter attend some council meetings; more news articles be sent to the Pioneer and Sailor newspapers; report to residents regarding survey results; notification in the Medina news that residents are encouraged to attend council meetings with g°uestions and comments to be received at 7:15 p.m. prior to .Mart of meetings. Moved by Thies, seconded by Mitchell to accept the recommendations of the communications committee. Motion declared carried 9. FAKE MINNETONKA CABLE COMMUNICATIONS COMMISSION Moved by Acromite, seconded by Mitchell to table appointment to the Lake Minnetonka Cable Communications Commission until July 2, 1991. Motion declared carried 10. MINNEGASCO Council discussed letter from Minnegasco regarding cost to extend gas lines on Co. Rd. 24 to city gall. Moved by Mitchell, seconded by Thies to table the matter until July 2nd lending receipt of additional information. Motion declared carried 11. SALES TAX Ron Batty explained that the one half percent sales tax increase that goes into effect on July 1 expires on December 31st with counties having to adopt a resolution to continue the increase and if not done cities within a county with population totally over 50% of the total population can overide the county decision. He stated that cities in Hennepin County will lose $2.40 for every $1.00 collected and cities may possibly have to increase tax levies to make up for the difference. Council discussed the legislatures responsibility versus counties and cities having to make such decisions. Moved by Zietlow, seconded by Mitchell to urge thie Hennepin County Board of Commissioners not to continue the one half percent sales tax increase after December 31, 1991. Motion declared carried 12. HWY. 12 CORRIDOR Jim ®illman reported that Hwy. 55 and Co. Rd. 11 corridors had been removed from the routes to be studied for Hwy. 12 improvements. He stated that the three southerly routes remain in the sutdy although the Orono City representative had requested that the southerly- route through Orono also be taken out of the study. Gary Acromite stated that Medina citizens have requested an update on the study. Philip Zietlow stated that the traffic counts were somewhat incorrect but would not make a great deal of difference to the overall planning. 13. COMPREHENSIVE PLAN MAPS Gary Acromite stated that maps need to be redone for the comprehensive plan amendment, some of them immediately and some not until after the public hearing and the July 2nd city council meeting. He stated that John Borgley had the original maps and had estimated that it would cost from $1100- $1400 to redo the maps. Moved by Acromite, seconded by Mitchell to have John Ber ley update the comprehensive plan maps at a cost of $1100-$1400. Motion declared carries:_ 14. MOONEY LAKE/LAKE MEDINA Council discussed a request from the city of Plymouth for an ordinance to control boat motors on Mooney Lake. Donna Roehl stated that she 'gad included Lake Medina in the memo should council wish to also consider that lake at this time. She stated that the existing ordinance addresses Holy Name Lake and only allows electric motors, while the Plymouth ordinance allows 5.4 hp motors on Mooney Lake. Moved by Mitchell, seconded by ACromite to authorize staff to prepare an ordinance amend- ment to include Mooney Lake with Holy Name Lake with regards to regulating boat motors. Motion declared carried 15. SPECIAL EVENTS PERMITS Moved by Acromite, seconded by Thies to table the special events application and permit forms until a later meeting. Motion declared carried 85 16. STREET OF DREAMS Philip Zietlow asked if sufficient planning had been done to regulate the Street of Dreams event, especially with regards to music. Donna Roehl read some of the itinerary that had been planned and if anyone received complaints they should call an onsite office for a response. 17. FOCUS GROUPS Donna Roehl reported that approximately 50 residents had been selected to serve on a focus group to receive information for long range planning by the Metropolitan Waste Control. Philip Zietlow asked if all of the Planning Commission members could be added to the list of those who will be contacted. 18. HUNTER FARMS PARK Philip Zietlow reported that the q-uestionaire for residents of Hunter Farms park was being completed and the survey and results would be forwarded to council in the near future. 19. TUCKBOROUGH FARM/WCCO EASEMENT Robert Mitchell asked that the petition from Jim Fenning with regards to vacating the road and utility easement in Tuckborough farm be referred to the city attorney so that whatever needs to be done with it is done according to time allowed. Gary Acromite stated that he wanted to wait for the comprehensive plan to be finalized before any council action is taken. 2.0 . * HOLY NAME CHURCH Moved by Mitchell, seconded by Scherer to grant an On -Sale Non Itoxicating Malt Liquor license to Holy Name Church for July 20 and 21, Y991. Motion declared carried 21. }PAYMENT OF BILLS Moved by Thies, seconded by Mitchell to pay the bills; Order Checks # 9753-9760 in the amount of $5171.64 and Payroll Checks # 1221--'2232 in the amount of $14,760.03.
