HomeMy Public PortalAbout2000_05_09_r090The Town of I eesburg, trg ma RESOLUTION NO. 200-89 A RESOLUTION: AUTHORIZING A BALCH LIBRARY PRESENTED May 9, 2000 ADOPTED __May 9, 2000 PRESERVATION EASEMENT ON THE THOMAS WHEREAS, the Town of Leesburg, through the work of the Thomas Balch Library Commission, was awarded a state grant of $50,000.00 for the renovation of the historic Thomas Balch Library; and WHEREAS, Section 10.1-2213 (B) (4) of the Code of Virginia conditions the award of state funds on the Granteer' s donation of a perpetual easement for the purpose of preserving those features of the property which led to its designation as a historic landmark; and WHEREAS, since the building is designated as a locally historic landmark and comes under the jurisdiction of the town's preservation ordinance and Board of Architectural Review and the state review by the Department of Historic Resources is consistent with the preservation regulations of the town of Leesburg. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The Mayor is authorized to execute a perpetual preservation easement on the Thomas Balch Library to the Commonwealth of Virginia Board of Historic Resources substantially in the form of Attachment 1. Clem, Mayor Town of Leesburg The Town of eesburg, .trgtnta RESOLUTION NO. 2000-90 PRESENTED May 9, 2000 ADOPTED May 9, 2000 A RESOLUTION: AUTHORIZING A TIME .EXTENSION FOR COMPLETION OF PUBLIC IMPROVEMENTS AND APPROVING A PERFORMANCE GUARANTEE FOR SYCAMORE HILL PHASE I SECTIONS 2 AND 3, PHASE II SECTIONS 1 AND 2, AND THE RECREATION CENTER WHEREAS, BRE/Sycamore, L.L.C., the developer of Sycamore Hill Phase I Sections 2 and 3, Phase II Sections 1 and 2, and the Recreation Center, has not completed all the required public improvements in accordance with the approved construction drawings and town standards within the two- year period agreed to in the contract for public improvements; and WHEREAS, the developer has requested a time extension to complete the public improvements; and WHEREAS, cash bonds in the following amounts have been provided by the developer to guarantee the installation of public improvements in Sycamore Hill Phase I Sections 2 and 3, Phase II Sections 1 and 2, and the Recreation Center: ; and Phase I, Section 2 - Phase I, Section 3 - Phase II, Section 1 - Phase II, Section 2 - Recreation Center - $33,058.00 $49,545.00 $55,749.00 $25,997.00 $ 9,502.70 WHEREAS, the town's Director of Engineering and Public Works recommends a time extension to September 1, 2000 for completion of the public improvements. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The cash bonds in the amounts listed above are approved to guarantee the installation of public improvements in Sycamore Hill Phase I Sections 2 and 3, Phase II Sections 1 and 2, and the Recreation Center.
