MARSHALL HOME PRESERVATION FUND, INC. FOR THE TOWN TO INSTALL AND MAINTAIN A SIDEWALK ON EAST MARKET STREET WHEREAS, the Town Council funded a sidewalk project along East Market Street from the east wye to Harrison Street identified as the East Market Street Brick Sidewalk and Pavement Widening project; and WHEREAS, the proposed sidewalk cannot be installed within the existing right-of-way; and WHEREAS, the Dodona Manor property has a National Historic Landmark designation which prohibits acquisition of right-of-way or easement for sidewalk construction; and WHEREAS, the town and George C. Marshall Home Preservation Fund, Inc. desire to construct the project; and WHEREAS, a License Agreement with the George C. Marshall Home Preservation Fund, Inc. would allow installation and maintenance by the town of a brick sidewalk and road improvements on the Dodona Manor property; and WHEREAS, the East Market Street Sidewalk project will remove an existing fence and trees; and WHEREAS, the George C. Marshall Home Preservation Fund, Inc. will accept $24,650.00 for the restoration of the fence and trees. A RESOLUTION: -2- AUTHORIZING A LICENSE AGREEMENT WITH THE GEORGE C. MARSHALL HOME PRESERVATION FUND, INC. FOR THE TOWN TO INSTALL AND MAINTAIN A SIDEWALK ON EAST MARKET STREET THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The Mayor is authorized to sign the License Agreement in a form approved by the Town Attorney for construction and maintenance of the East Market Street Brick Sidewalk and Pavement Widening project. A payment of $24,650.00 to George C. Marshall Home Preservation Fund, Inc. for fence and tree restoration is also authorized. PASSED this 23rd day of May 2000. ATTEST: 10/ferk of Council J~'mes E.
