AN ORDINANCE AUTHORIZING A SPECIAL USE IN A R-3 ONE -TO -EIGHT FAMILY
RESIDENTIAL DISTRICT FOR A PROFESSIONAL OFFICE ON PROPERTY LOCATED
AT 301 SOUTH 4TH STREET PURSUANT TO ARTICLES 48 AND 22.012 OF CHAP-
TER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, OOIMNLY
MOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA.
WHEREAS, Article 22.012 of Chapter 154 of the M nicipal Code allows
a professional office by Special Use authorization as pro-
vided in Article 48 of said Chapter; and,
65, a notice was given and a public hearing on this Ordinance was
conducted by the Richmond City Plan Commission the 25th day
of August, 1981, at which time remonstrances were heard from
all parties interested in or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was nine (9) to
zero (0) in favor of recommending the passage of Ordinance No.
58-1981.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Rich-
mond, Indiana as follows:
SECTION 1. As provided in Articles 22.012 and 48 of Chapter 154 of the
Minicipal Code, the following described use of the following
described real estate is allowed as a Special Use for a pro-
fessional office at 301 South 4th Street in the City of Rich-
mond, Indiana; more particularly described to with:
A part of lot as numbered sixty-eight (68) of Original
Plat of City of Richmond as laid out by John Smith,
and described as follows: Commencing at a point on
the west line of said lot (South 4th Street) forty
(40) feet north of the southwest corner of said lot;
thence east and parallel with the lines of said lot
to the east side of said lot, (alley); thence south
along west line of alley and east line of lot, thirty-
eight (38) feet; thence west parallel to the north
line of lot as defined to west line of lot; thence
north along west line of lot, thirty-eight (38) feet
to the place of beginning, in Wayne County, Indiana.
A strip of ground forty-two and one-half (422) feet
wide off of the north side of lot number sixty-eight
(68) in that part of the City of Richmond laid off
by John Smith, in Wayne County, Indiana.
SECTION 2. This Ordinance shall be in full force and effect from and after
its passage and approval as by law required.
PASSED AND ADOPTED by the Common Council of the City of Richmond, Indiana,
this day of 1981.

Dear Mr. Mills, Members of Common Council & Mrs. Trimble:
The Richmond City Plan Commission conducted a public hearing
on Tuesday, August 25, 1981, on the petition of J. Scott
Porter and J. Steven Porter, owners; Kent Klinge, Agent,
requesting authorization for a Special Use for a law office
on property located at 301 South 4th Street.
Eight (8) notices of public hearing were sent to adjoining
property owners with none returned. One (1) person spoke
in favor of the request at the public hearing.
The property in question is zoned R-3 One -to -Eight Family
Residence District. Articles 48 and 22 of the Zoning Ordi-
nance set forth the criteria to be applied in granting
special uses for professional offices in the R-3 District.
The Plan Commission determined that the subject request
fulfills the requirements of the Zoning Ordinance for grant-
ing a Special Use.
Therefore, the Plan Commission voted nine (9) to zero (0)
to recommend passage of Ordinance No. 58-1981.
