HomeMy Public PortalAbout069-1981 - Special Use - 1921 Chester Blvd - SignSPECIAL ORDINANCE NO. 69-1981 AN ORDINANCE AMENDING SPECIAL USE ORDINANCE NO. 2-1980 WHICH AUTHORIZED A DENTAL OFFICE AT 1921 CHESTER BOULEVARD IN A R-3 ONE -TO -EIGHT FAMILY RESI- DENCE DISTRICT, FOR THE PURPOSE OF AMENDING THE APPROVED SPECIAL USE SITE PLAN TO PERMIT THE ERECTION OF A FREE-STANDING IDENTIFICATION SIGN. WHEREAS, the Comnon Council of the City of Richmond, Indiana has adopted Special Use Ordinance No. 2-1980 which authorized a dental office in an R-3 One -to -Eight Family Residence District located at 1921 Chester Boulevard; and, WHEREAS, it is the intent and purpose of this Ordinance to amend the Special Use site plan, which was approved and adopted as a part of Special Use Ordinance No. 2-1980 to authorize the erection of a sixty (60) square foot free-standing identi- fication sign at the location shown and identified in Exhibit "A" of this Ordinance; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Coianission the 22nd day of September, 1981, at which time remon- strances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Comnission was six (6) to zero (0) in favor of recommending the passage of Ordinance No. 69-1981. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows; SECTION 1. That the site plan accompanying the petition requesting the Special Use amendment shall be marked Exhibit "A" and made a part of this Ordinance. SECTION 2. That Special Ordinance No. 2-1980 is hereby amended to authorize the erection of a sixty (60) square foot free-standing identifica- tion sign to be located as shown on Exhibit "A' of this Ordinance. SECTION 3. As a condition of the aforesaid Special Use amendment being granted, the following requirement shall hereafter and at all times be met by the owner. a. In the event the right-of-way for Chester Boulevard should ever be further improved or widened, the owner of the prop- erty shall move the sigma at his own expense. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. I ATTEST City Clerk y`} CITY PLAN COMMISSION RICHMOND, INDIANA I'Affip, September 29, 1981 Mr. Kenneth Mills, President Members of Comnon Council & Mrs. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 69-1981 Plan Commission Case PC-81-11 Dear Mr. Mills, Members of Common Council & Mrs. Trimble: The Richnund City Plan Commission conducted a public hearing on Tuesday, September 22, 1981, on the petition of Dr. Gerald Ackerman; Andrew Cecere, Agent, requesting to amend Special Use Ordinance No. 2-1980 which authorized a dental office in a R-3 One -to -Eight Family Residence District at 1921 Chester Boulevard. The requested amendment seeks authorization for an existing sixty (60) square foot free-standing identification sign located approximately one (1) foot behind the right-of-way line of Chester Boulevard. Dr. Eckermman erected the subject free-standing sign without prior approval and unaware of the Zoning Ordinance requirements pertaining to the size and location of the sign. To grant Dr. Ackerman's petition as requested would require a modification of the normal R-3 zoning district regulations regarding signs. Ten (10) notices of public hearing were sent to adjacent property owners with none returned. During the public hearing, no one spoke in opposition to or in favor of the petition. The Plan Commission considered the following in making their determination: 1. The Counnn Council, upon recommendation of Plan Commis- sion, has absolute authority over every aspect of a Special Use in either approving, denying or conditionally approving such use. 2. Captain Wogoman of the Traffic Division has inspected the existing sign and anticipates no traffic related problems as a result of the sign location. 3. The topography of the land and location of a state his- torical monuanent would limit the sight distance and act to obscure the sign if the sign were placed according to Zoning Ordinance requirements. Mr. Kenneth Mills, President Members of Conuion Council Ordinance No. 69-1981 September 29, 1981 Page 2 Therefore, the Plan Commission voted six (6) to zero (0) to recommend that Ordinance No. 69-1981 be approved with the following condition: 1. In the event the right-of-way for Chester Boulevard should ever be further improved or widened, the owner of the property shall move the sign at his own expense.
