A RESOLUTION: PRESENTED July 25, 2000 2000-146 ADOPTED July 25, 2000 INITIATING AMENDMENTS TO THE ZONING ORDINANCE, AND SUBDIVISION AND LAND DEVELOPMENT REGULATIONS TO RESTRICT THE USE OF A COMMON PARKING COURT TO SERVE ONLY SINGLE-FAMILY ATTACHED (TOWNHOUSE) DWELLING UNITS WHEREAS, the Transportation Element of the 1997 Town Plan specifies that "common parking courts" are not appropriate for single-family detached dwellings or duplexes; and WHEREAS, Road System Policy #10 of the 1997 Town Plan states that, "Construction of private streets will be discouraged, however, private streets which serve townhouse development will be considered"; and WHEREAS, amendments to the Leesburg Zoning Ordinance and Subdivision and Land Development Regulations that restrict the use of common parking courts to townhouse development is consistent with the 1997 Town Plan and is in the best interest of the public necessity, convenience, general welfare and good planning practice: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The following text amendments to Section 13-75(c) of the Leesburg Subdivision and Land Development Regulations are hereby initiated and referred to the Planning Commission for recommendation: Section 13-75 LOTS (c)(2) Dwellings Abutting Common Parking Courts. .... - ....... ~ ,-,,~ single-family attached dwelling lots may abut but not extend into a common parking court provided that: (c)(2)((d)) Maximum Dwelling Served. Each approved common parking court shall serve no more than a total of single-family attached dwelling lots. -2- INITIATING AMENDMENTS TO THE ZONING ORDINANCE AND SUBDIVISION AND LAND DEVELOPMENT REGULATIONS TO RESTRICT THE USE OF A COMMON PARKING COURT TO SERVE ONLY SINGLE-FAMILY ATTACHED (TOWNHOUSE) DWELLING UNITS SECTION II. The following text amendments to Section 8A-8 of the Leesburg Zoning Ordinance are hereby initiated and referred to the Planning Commission for recommendation: Section 8A-8. NUMBER OF OFF-STREET PARKING SPACES REQUIRED BY LAND USE (1)a. Dwelling, Single Family Detached. 2.0 spaces per dwelling if access to the lot is onto a public street; 2.5 spaces per dwelling if access to the lot is from a private street, or common drive or (1)c. Dwelling, Two-Family. 2.0 spaces per dwelling if access to the lot is onto a public street; 2.5 spaces per dwelling if access to the lot is from a private street, or common drive or ........... v ..... ~, ...... SECTION III. Pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended, a notice that amendments to the Subdivision and Land Development Regulations and Zoning Ordinance to restrict the use of common parking courts to townhouse development will be considered jointly by the Leesburg Town Council and the Leesburg Planning Commission shall be published in the Leesburg Today on July 26 and August 2, 2000 for a Joint Public Heating to be held on August 8, 2000 in the Council Chambers of the Government Center at 25 West Market Street, Leesburg, Virginia, 20176.
