AN ORDINANCE AUTHORIZING A SPECIAL USE AT 113 SOUTH 3RD STREET BEING
IN AN R.-3 ONE-TO-EI= FAMILY RESIDENTIAL DISTRICT, OF ORDINANCE NO.
2325-1968, COP'1MONLY KNOjaN AS THE ZONING ORDINANCE FOR THE CITY OF
RICHmND, INDIANA, ADOPTED JUNE 3, 1968.
VNEREA.S, Article 22 of the 7oning Ordinance permits Council to authorize
business use of structures in this district with certain con-
ditions; and,
WHEREAS, the petitioners have submitted plans and details of operation
to satisfy the conditions set forth in Article 22; and,
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Rich-
mond, Indiana, as follows:
SECTION 1. That the amended site plan accompanying this Ordinance be
attached as Exhibit "A" and made a part hereof; and,
SECTION 2. That the following described property is permitted to house
an insurance office to operate in accordance with the peti-
tioner's request as shown in the Plan Commission minutes of
November 24, 1981.
Lot #2 in that part of the City of Richmond laid out by
Achilles williams; also, the north half of the vacated
alley adjoining said lot on the south, and described as
follows:
Beginning at the soutwest corner of said Lot #2; thence
east along the south line thereof to the southeast cor-
ner thereof; thence south 5 feet; thence west parallel
with the south line of said lot to the east line of
South 3rd Street; thence north 5 feet to the place of
beginning.
SECTION 3. That should the Special Use of the above described property
cease for a period of one (1) year or more the Special Use
authorization shall be null and void; and,
SECTION 4. This Ordinance shall be in full force and effect from and
after its passage and approval as required by law.

Dear Mx. Mills, Members of Can Council and Mrs. Trimble:
The Richmnd City Plan Commission conducted a public hearing on this
Ordinance on November 24, 1981.
The staff sent thirteen_ (13) letters to adjoining property owners; one
(1) was returned in favor of the request and none were returned in opposi-
tion.
The Police Traffic Division reviewed the request and noted no traffic
problems.
The request was presented by Mr. Tom Milligan, Attorney and Agent for
the petitioner. No one spoke in opposition to the request. The Conmis-
sion voted unanir.�ously to recorumnd approval of the request with the
following conditions:
1. The approval be null and void if the Special Use
sets empty for a period of one (1) year or more.
2. The site plan be amended to move the service yard
to the southeast corner of the site and that the
parking area be paved and developed in accordance
with Article 41 of the Zoning Ordinance.
3. Amended site plan be marked EA-ibi_t "A' and made a
part of the Ordinance authorizing the Special Use.
