ADOPTED JUNE 3, 1968 PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1118 NORTH "J" STREET TkT,94 R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT TO C-2 CG%MERCIAL DISTRICT. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 desig- nates and describes as R-3 One -to -Eight Family Residence District the property located at 1118 North "J" Street. WHEREAS, it is the intent and purpose hereof to change the zoning classi- fication of property located at 1118 North "J" Street from R-3 One -to -Eight Family Residence District to C-2 Commercial Dis- trict; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 2nd day of February, 1982, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. WHEREAS, the vote of the Richmond City Plan Commission was six (6) to zero (0) in favor of recommending that Amended Ordinance No. 90-1981 be stricken. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Rich- mond, Indiana as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to C-2 Commercial District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. The following described real estate situated in the City of Richmond, Wayne County, State of Indiana to wit: Lots 16, 15, 14, 13 and the east one-half of Lot 12 in the B. Fulghun's Addition. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. This Ordinance, if adopted, would rezone 1118 North "J" Street (this address also includes the vacant lots formerly known as 1120, 1122 and 1124 North "J" Streets) from R-3 to C-2. During the Common Council's hearing on this Ordinance, an interest was indicated in seeing the property immediately west of 1118 North "J" Street included in the proposed rezoning in the interest of sound land use planning so to eliminate an isolated pocket of resi- dential zoning in an otherwise commercial block. The Planning Department has contacted the two property owners involved and determined they have no objection to their property being rezoned to C-2. The Plan Commission has initiated Ordinance No. 4-1982, which if adopted, would rezone not only 1118 North "J" Street, but also 1001 North llth Street and 1110 North "J" Street. Therefore, the Plan Commission voted that Amended Ordinance No. 90-1981 be No. 4-1982 be approved. Respectfully submitted, CI , CDWESSIO Robert B. Grimes, owner; requesting a rezoning from R-3 One -to -Eight Family Residence Dis- trict to C-4 ('meral Business District on property located at 1118 North "J" Street. Six (6) notices of public hearing were sent to adjoining property owners with none returned. No one spoke in favor of or in opposition to the petition. during the public hearing. The Plan Commission determined that the general character of the subject area has charged since the adoption of the Master Plan from residential to cam. ercial. However, the predominate commercial uses located adjacent to North loth Street and North "J" Street are retail and serve uses that are first permitted in either the C-1 or C-2 zoning districts and that the requested C-4 zoning would not be com- patible with the existing land use patterns.
