A RESOLUTION AUTHORIZING ACCEPTANCE OF INFRASTRUCTURE IN
WHISPERING WINDS PHASE I
WHEREAS, the Final Plat for Whispering Winds Subdivision Phase I was
approved by the Greencastle Plan Commission on May 29, 2016; and
WHEREAS, the Plan Commission approved waiving the posting of surety for the
subdivision at that time; and
WHEREAS, the infrastructure has been inspected by city departments including
the city engineer, utilities superintendent, director of public works and city planner; and
WHEREAS, the infrastructure installed has passed inspections; and
WHEREAS, the developer is in agreement to pay the city for infrastructure not
yet installed as outlined in the attached letter; and
WHEREAS, the attached letter acts as the equivalent of a Maintenance Bond;
and
WHEREAS, the Greencastle Board of Works has reviewed the information at
their regular meeting on November 20, 2019; and
WHEREAS, the Board of Works recommends approval of the arrangements
outlined in the attached letter; and
WHEREAS, the Greencastle Subdivision Ordinance Article 4.9
Completion/Acceptance of Improvements B3 states "the City Council shall approve a
resolution, accepting the improvements;" and
NOW THEREFORE, BE IT RESOLOVED that the Greencastle Common Council
authorizes the acceptance of said infrastructure as outlined in that attached letter.
PASSED AND RESOLVED by the Common Council of the City of Greencastle
on this 12th day of December 2019.

Whispering Winds Phase I infrastructure final inspections
After documenting inspections from 2017, contacting all other department heads and public utilities about
any remaining concerns, and reviewing the infrastructure construction and site development with City
Engineer Jeff Mahan, I recommend acceptance of the infrastructure based on the following findings and
conditions:
Since the infrastructure work was done more than 3 years ago and has proven to be of appropriate quality,
no maintenance bond will be required. In lieu of a performance bond for the small percentage of sidewalk
and curb work remaining (see list below),the developer has agreed to pay the city $_7,680.00_. If the
work is accomplished and deemed acceptable prior to December 31, 2021, the money shall be returned.
Trees for remaining undeveloped lots will be maintained by the developer. If lots remain undeveloped by
May, 2020,the trees will be made available to existing property owners or Greencastle departments for
planting in public spaces.
Acceptance would be dependent on payment to the city in lieu of bonding and for the following work:
• Installation of three (3) speed limit signs as shown on construction plan C2.1
• Correction of drainage between lots 70 & 71 to meet requirements of Storm Water Pollution
Prevention Plan.
• Removal or engineering approval of check dam behind lot 58.
• Removal of temporary drainage baskets in storm water inlets
