A RESOLUTION:
AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES
FOR RIVER CREEK PARKWAY SOUTH, RIVER CREEK PHASE 1,
SECTION iA, PHASES II & III, SECTION 1; PHASE II, SECTIONS 3 & 3A;
PHASE IV, SECTION 1; PHASE II, SECTION 2; PHASE II, SECTION 2B;
AND THE GOLF COURSE FACILITIES
WHEREAS, River Creek, L.L.C., the developer of River Creek Parkway South, River Creek
Phase 1, Section IA, Phase II & III, Section 1; Phase II, Section 3 & 3A, Phase IV, Section 1; Phase II,
Section 2; Phase II, Section 2B; and the Golf Course Facilities, has not completed all the required public
improvements in accordance with the approved construction drawings and town standards within the two-
year period agreed to in the contract for public improvements and previously approved time extensions;
and
WHEREAS, the developer has requested a time extension to complete the public improvements;
and
WHEREAS, the subdivision is in Loudoun County and the town's bonded improvements are
water and sanitary sewer only; and
WHEREAS, corporate surety bonds in the following amounts from the Fidelity & Deposit
Company of Maryland were provided by the developer to guarantee the installation of public
improvements in River Creek Parkway South, River Creek Phase 1, Section lA, Phase II & III, Section 1;
Phase II, Section 3 & 3A, Phase IV, Section 1; Phase II, Section 2; Phase II, Section 2B; and the Golf
Course Facilities:
River Creek Parkway South - $101,712.70
River Creek Phase 1 Section IA, Phase II & III, Section 1 - $28,294.10
Phase II, Section 3 & 3A - $42,514.67
Phase IV, Section 1 - $22,000.00
Phase II, Section 2 - $7,597.30
Phase II, Section 2B - $4,970.70
Golf Course Facilities - $41,889.10
and

SECTION IA, PHASES II & III, SECTION 1; PHASE II, SECTIONS 3 & 3A;
PHASE IV, SECTION 1; PHASE II, SECTION 2; PHASE II, SECTION 2B;
AND THE GOLF COURSE FACILITIES
WHEREAS, the town's Director of Engineering and Public Works recommends time extensions
as follows for completion of the public improvements:
River Creek Parkway South - June 7, 2001
River Creek Phase 1 Section iA, Phase II & III, Section 1 - April 16, 2001
Phase II, Section 3 & 3A - May 13, 2001
Phase IV, Section 1 - November 13, 2001
Phase II, Section 2 - June 9, 2001
Phase II, Section 2B - June 9, 2001
Golf Course Facilities - April 25, 2001
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The corporate surety bonds from the Fidelity & Deposit Company of Maryland in
the amounts listed above are approved to guarantee the installation of public improvements in River
Creek Parkway South, River Creek Phase 1, Section IA, Phase II & III, Section 1; Phase II, Section 3 &
3A, Phase IV, Section 1; Phase II, Section 2; Phase II, Section 2B; and the Golf Course Facilities.
SECTION II. The time extensions recommended by the Director of Engineering and Public
Works for completion of the public improvements in River Creek Parkway South, River Creek Phase 1,
Section IA, Phase II & III, Section 1; Phase II, Section 3 & 3A, Phase IV, Section 1; Phase II, Section 2;
Phase II, Section 2B; and the Golf Course Facilities are approved.
PASSED this 12th day of September 2000.
