RESOLUTION NO. 2000-170 ADOPTED September 12, 2000
A RESOLUTION: AWARDING A CONTRACT FOR CONSTRUCTION OF THE ANNE
STREET STORM DRAINAGE IMPROVEMENTS PROJECT TO
RUSTLER CONSTRUCTION, INC. IN THE AMOUNT OF $118,900
AND MAKING A TRANSFER OF FUNDS
WHEREAS, the FY00 Capital Improvement Program includes a project for improving
storm drainage on a portion of Anne Street; and
WHEREAS, in response to a public solicitation for bids for construction of the project,
the town received bids from the following firms:
Rustler Construction, Inc.
· R.L. Rider & Company
· Gull Corporation

$159,000
WHEREAS, the bid was evaluated by the Contracts Administrator in accordance with the
town Purchasing Policy; and
WHEREAS, Rustler Construction, Inc. of Herndon, Virginia was determined to be the
lowest responsive and responsible bidder; and
WHEREAS, the Director of Finance reports that the available balance in Account 903-
9320 for construction of the project is $50,000; and
WHEREAS, an appropriation of $75,000, including an allowance of 5% of the bid price
for contingencies, will be necessary to complete funding of the project; and
WHEREAS, the Director of Engineering and Public Works, and the Contracts
Administrator recommend awarding a contract to Rustler Construction, Inc. in the amount of
$118,900 for construction of the Anne Street Storm Drainage Improvements project.

STREET STORM DRAINAGE IMPROVEMENTS PROJECT TO
RUSTLER CONSTRUCTION, INC. IN THE AMOUNT OF $118,900
AND MAKING A TRANSFER OF FUNDS
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The town manager is authorized to execute a contract with Rustler
Construction, Inc. in the amount of $118,900 for construction of the Anne Street Storm Drainage
Improvements.
SECTION II. The Director of Finance is authorized to transfer $75,000 from the
contingency fund for debt reduction to Budget Account 902-9320-700-725 to complete funding
of the project.
