AUTHORIZING AN AGREEMENT AND APPROVING A
PERFORMANCE GUARANTEE AND A WATER EXTENSION
PERMIT FOR EDWARDS LANDING EDWARDS FERRY ROAD
IMPROVEMENTS AND ACCEPTING A CASH PAYMENT IN LIEU
OF CONSTRUCTION OF A SEGMENT OF THE ROAD
IMPROVEMENTS
. WHEREAS, Edwards Landing LLC, the developer of Edwards Landing Edwards Ferry
Road Improvements has requested approval of a corporate surety bond in the amount of
$366,725.70 to guarantee the public improvements in Edwards Landing Edwards Ferry Road
Improvements; and
WHEREAS, the Director of Engineering and Public Works recommends approval of a
contract for installation of public improvements and acceptance of a performance guarantee for
Edwards Landing Edwards Ferry Road Improvements; and
WHEREAS, the developer, Edwards Landing LLC, has requested that the town accept a
cash payment in lieu of construction of approximately 100 feet of roadway improvements in
Edwards Ferry Road between Station 42+75 to Station 43+75; and
WHEREAS, the estimated cost of the proposed deferred improvements is $30,000.00;
and
WHEREAS, all the roadway improvements must be installed or paid for by the developer
to comply with the town's Subdivision and Land Development Regulations; and
WHEREAS, deferral of construction will not adversely effect the public use of Edwards
Ferry Road.

IMPROVEMENTS
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The town manager shall execute the contract for public improvements for
the improvements shown on the plans approved by the Director of Engineering and Public
Works for Edwards Landing Edwards Ferry Road Improvements.
SECTION II. The extension of municipal water for Edwards Landing Edwards Ferry
Road Improvements are approved in accordance with Section 19-18 of the Town Code.
SECTION III. The corporate surety bond in a form approved by the town attorney from
The Continental Insurance Company in the amount of $366,725.70 is approved as security to
guarantee installation of the public improvements shown on plans approved by the Director of
Engineering and Public Works for Edwards Landing Edwards Ferry Road Improvements.
SECTION IV. The Town Council hereby accepts a cash payment of $30,000.00 in lieu of
construction of approximately 100 feet of roadway improvements in Edwards Ferry Road
between Station 42+75 to Station' 43+75. The $30,000.00 shall be held in a capital project
account for Edwards Ferry Road to be used for the installation of roadway improvements.
