AUTHORIZING AN AGREEMENT AND APPROVING A
PERFORMANCE GUARANTEE AND WATER AND SEWER
EXTENSION PERMITS FOR RIVER CREEK PHASE III, SECTION 4
(LANDBAY F) & RIVER CREEK PHASE V, SECTION 2 (LANDBAY
M)
WHEREAS, River Creek, L.L.C., the developer of River Creek Phase III, Section 4
(Landbay F) & River Creek Phase V, Section 2 (Landbay M) has requested approval of corporate
surety bonds from the Fidelity and Deposit Company of Maryland in the amount of $54,379.00
and $75,831.80 to guarantee the public improvements in River Creek Phase III, Section 4
(Landbay F) & River Creek Phase V, Section 2 (Landbay M)
WHEREAS, the Director of Engineering and Public Works recommends approval of a
contract for installation of public improvements and acceptance of performance guarantees for
River Creek Phase III, Section 4 (Landbay F) & River Creek Phase V, Section 2 (Landbay M).
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The manager shall execute the contracts for public improvements for the
improvements shown on the plans approved by the Director of Engineering and Public Works for
River Creek Phase III, Section 4 (Landbay F) & River Creek Phase V, Section 2 (Landbay M).
SECTION II. The extension of municipal water and sewer for River Creek Phase III,
Section 4 (Landbay F) & River Creek Phase V, Section 2 (Landbay M) is approved in
accordance with Sections 15-9 and 19-18 of the Town Code.

SECTION III. The corporate surety bonds in a form approved by the town attomey from
the Fidelity and Deposit Company of Maryland in the amount of $54,379.00 and $75,831.80 are
approved as security to guarantee installation of the public improvements shown on plans
approved by the Director of Engineering and Public Works for River Creek Phase III, Section 4
(Landbay F) & River Creek Phase V, Section 2 (Landbay M).
