AUTHORIZING EMERGENCY/SOLE-SOURCE AWARDS OF TENDER
AGREEMENTS REGARDING WASTEWATER TREATMENT PLANT
A RESOLUTION:
WHEREAS, staff recommends awarding the Tender Agreements regarding the
wastewater treatment plant to Beating Construction, Inc. on an emergency and sole-source
basis for the reasons explained in the attached Executive Summary; and
WHEREAS, such procurement is being made with such competition as is practicable
under the circumstances, the bonding company having requested proposals from other
contractors; and
WHEREAS, Council hereby determines that there is an emergency requiring that such
awards be made without competitive sealed bidding or competitive negotiation because the
original contractor has defaulted and it is necessary to engage a new contractor as soon as
possible to avoid unacceptable delays in the completion of these projects, timely completion of
which is mandated by the State Department of Environmental Quality; and
WHEREAS, Council hereby determines that there is only one source practicably
available given the time constraints and the fact that the new contractor will have the same
principals and supervisors as the original contractor, permitting a smooth transition.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that
the Tender Agreements shall be negotiated and awarded on an emergency and sole-source
basis.
