Dear Mr. Fleetwood: This Letter of Permission (LOP) is in response to your request to repair/replace the dune crosswalk and gazebo located at#1 6th Place, Tybee Island, Chatham County, Georgia. On January 1, 2009, the property was severely damaged by fire. The existing crosswalk was destroyed and the gazebo roof damaged. In addition the residence also suffered major damage. A Shore Protection Act Jurisdiction (SPA) Line has been marked for the property. The crosswalk and gazebo are in the state's jurisdiction but the residence is not. Therefore, any repair to the residence does not require authorization from the Department as long as no work extends seaward of the jurisdiction line as depicted on the attached survey. The current jurisdiction of the state under the Shore Protection Act O.C.G.A. 12-5-230 et seq. is seaward of the existing single-family residence; therefore, no permits are required for repair of the residential structure as long as the structure is rebuilt behind the Shore Protection line as marked by staff. The dune crossover and gazebo are in the jurisdiction of the Shore Protection Act and require authorization from the Department to proceed with reconstruction. As discussed on site, the crossover and gazebo may be rebuilt in the same footprint with a Letter of Permission (LOP) from the Department.
