AFFIRMING THE INSTALLATION OF UNDERGROUND
CONDUITS FOR FUTURE FIBER OPTICS LINES WITHIN THE
LIMITS OF THE SOUTH KING STREET IMPROVEMENTS PROJECT
AND MAKING A TRANSFER OF FUNDS
WHEREAS, the town wishes to lessen the impact of the future installation of
underground fiber optics lines within town owned street rights-of-way; and
WHEREAS, including the installation of underground conduits within the limits of the
South King Street Improvements project would eliminate the need to excavate the street in the
future if fiber optics lines are installed; and
WHEREAS, the town's contractor, Rustler Construction Company, was issued a work
directive to install four (4) - four (4) inch diameter conduits; and
WHEREAS, the conduits have been installed and the final price of the Change Order is
$82,210.00; and
WHEREAS, sufficient contingency funds are not available in the project budget to cover
the $82,210.00 cost; and
WHEREAS, The Director of Engineering and Public Works recommends the transfer of
funds from the debt reduction account to fund the cost of the conduit installation for furore fiber
optics lines.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:

LIMITS OF THE SOUTH KING STREET IMPROVEMENTS PROJECT
AND MAKING A TRANSFER OF FUNDS
SECTION I. A change order in the amount of $82,210.00 to the town's contract with
Rustler Construction, Inc. is hereby affirmed for the installation of underground conduit for
future fiber optics in the 300 and 400 blocks of South King Street.
SECTION II. The Director of Finance is authorized to transfer $82,210.00 from the
contingency fund for debt reduction to Budget Account 903-9314-700-725.
