A RESOLUTION: DENYING REZONING APPLICATION #ZM 2000-02 FOR 24 CHURCH
STREET
WHEREAS, on May 8, 2000, the Town accepted rezoning application #ZM 2000-02 for 24
Church Street, to rezone a 0.411 acre lot at the Southeast comer of Church Street and Cornwall Street,
from R-HD/H-1 to B-l/H-1 with proffers; and
WHEREAS, the Planning Commission held a public hearing on this application on July 20,
2000; and
WHEREAS, the Planning Commission recommended approval of this application, subject to
resolution of certain outstanding concerns on September 7, 2000; and
WHEREAS, the applicant revised the concept plan and proffers to address some of the
outstanding concerns; and
WHEREAS, the Council held a public hearing on this application on October 31, 2000; and
WHEREAS, the applicant further revised the concept plan and proffers to address some, but not
all of the remaining Town Council concerns; and
WHEREAS, the proposed B-1 rezoning application and revised proffers do not conform
to the Town Plan as set forth in the General Land Use Policies since the office use does not assure a
compatible transitional use relative to the established development pattern thereby creating an adverse
impact on the existing residential properties in the immediate neighborhood; and
WHEREAS, the proposed B-1 rezoning application and revised proffers are not in the interest of
public health, safety, general welfare and good planning practice:

THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
Rezoning application #ZM 2000-02 for 24 Church Street is hereby denied.
