RESOLUTION NO. 2000-231 ADOPTED November 28, 2000
ARESOLUTION: AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF
PUBLIC IMPROVEMENTS AND APPROVING PERFORMANCE
GUARANTEES FOR RIVER CREEK PHASE 1, SECTION 2; PHASE
II, SECTION 2A; PHASE II, SECTION 2C; AND PHASE III, SECTION
6
WHEREAS, River Creek, L.L.C., the developer of River Creek Phase 1, Section 2; Phase
II, Section 2A; Phase II, Section 2C; and Phase III, Section 6, has not completed all the required
public improvements in accordance with the approved construction drawings and town standards
within the two-year period agreed to in the contract for public improvements; and
WHEREAS, the developer has requested a time extension to complete the public
improvements; and
WHEREAS, the subdivision is in Loudoun County and the town's bonded improvements
are water and sanitary sewer only; and
WHEREAS, corporate surety bonds from the Fidelity & Deposit Company of Maryland
in the amount of $12,031.25 for Phase I, Section 2; $9,096.70 for Phase II, Section 2A;
$18,797.90 for Phase II, Section 2C; and $19,707.90 Phase III, Section 6 were provided by the
developer to guarantee the installation of public improvements; and
WHEREAS, the town's Director of Engineering and Public Works recommends time
extensions as follows for completion of the public improvements:
Phase I, Section 2 - November 17, 2001
Phase II, Section 2A - September 8, 2001
Phase II, Section 2C - September 8, 2001
Phase III, Section 6 - October 13, 2001

II, SECTION 2A; PHASE II, SECTION 2C; AND PHASE III, SECTION

THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The corporate surety bonds from the Fidelity & Deposit Company of
Maryland in the amounts listed above are approved to guarantee the installation of public
improvements in River Creek Phase I, Section 2; Phase II, Section 2A; Phase II, Section 2C; and
Phase III, Section 6.
SECTION II. The time ext.ensions for completion of the public improvements in River
Creek Phase I, Section 2; Phase II, Section 2A; Phase II, Section 2C; and Phase III, Section 6 are
approved as follows:
Phase I, Section 2 - November 17, 2001
Phase II, Section 2A - September 8, 2001
Phase II, Section 2C - September 8, 2001
Phase III, Section 6 - October 13, 2001
