RESOLUTION NO. 2000-235 ADOPTED December 12, 2000
A RESOLUTION: AWARDING A CONTRACT FOR CONSTRUCTION OF THE EAST
MARKET STREET SIDEWALK PROJECT TO RUSTLER
CONSTRUCTION, INC. IN THE AMOUNT OF $ 250,000.00
WHEREAS, the FY01 Capital Improvement Program includes a project for the
construction of new curb and gutter, sidewalks, and storm sewer pipes and inlets along East
Market Street from the intersection of Harrison Street to the intersection of Loudoun Street; and
WHEREAS, in response to a public solicitation for bids for construction of the project,
the town received bids from the following firms:
Rustler Construction, Inc.
· Finley Asphalt & Sealing, Inc.
· Gull Corporation
; and
$ 250,000.00
$ 339,475.00
$ 343,851.00
WHEREAS, the bids were evaluated by the Director of Engineering and Public Works in
accordance with the town Purchasing Policy; and
WHEREAS, Rustler Construction, Inc., was determined to be the lowest responsive and
responsible bidder; and
WHEREAS, a prior appropriation of $280,000.00 for design, easement acquisition and
construction is included in the FY01 budget for this capital project; and
WHEREAS, bond funds from the year 2000 bond sale in the amount of $325,000.00
were allocated to fund this project and these bonds have been sold; and

CONSTRUCTION, INC. IN THE AMOUNT OF $250,000.00
WHEREAS, the Director of Engineering and Public Works recommend awarding a
contract to Rustler Construction, Inc. in the amount of $250,000.00 for construction of the East
Market Street Sidewalk project.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The Town Manager is authorized to execute a contract with Rustler
Construction, Inc. in the amount of $250,000.00 for construction of the East Market Street
Sidewalk project.
SECTION II. The Town Council hereby appropriates an additional $45,000 from the
year 2000 bond funds to be transferred to Capital Project Account 902-9249-700-725.
