Those in attendance in addition to those listed at the Board of Review meeting were: Councilmember, Thomas Crosby at 8:25 P.M.; Public Works Director, Ron Duran; Chief of Police, Charles hoover; Planning and Zoning Administrator, Robert Derus; Attorney Richard Schaeffer; Engineer, Lyle Swanson; Building Inspector, Loren Kohnen. 1. minutes of June 5, 1979: Sarah Lutz asked that the following be included in Item 4, Page 209, Medina Morningside Park: emotion subject to the ability to cancel the order of 3 items of playground equipment.ft Also, useveral pages of suggestions were presented by Mrs. Peterson." Motion by Lutz, seconded by Reiser to accept the minutes of June 5th, with the above correct- ions. Motion declared carried 2. POLICE DEPARTMENT Public Safety Committee Council discussed the letter prepared by the Committee to the Long Lake Council regarding a joint powers agreement. Motion by Reiser, seconded by Lutz to forward the letter to Long Lake. Motion declared carried 3. PUBLIC WORKS DEPARTMENT County -State Aid Funds Ron Duran stated that the streets in Independence Beach needed to be sealcoated. Also the money could be used for construction, such as Hamel Rd., Pinto Dr., Tower Dr. project. Motion by Lutz, seconded by Laurent to authorize the engineer to prepare the application to seal -coat the Independence Beach streets. Motion declared carried Minnesota Gas Company Motion by Reiser, seconded by Lutz to adopt Resolution 79-28, allowing the installation of gas lines to serve 450 Red Fox Dr. Motion declared carried Road Posting Discussion of resolution that had been presented byBob Mitchell, attorney, regarding issuance of special permits to use posted roads. Richard Schieffer stated that the ordinance could be amended to include standards for the issuance of such permits. Motion by Laurent, seconded by Reiser not to change the ordinance at this time so as not to become involved in allowing the use of posted roads, for any reason. Motion declared carried Northern States Motion by Lutz, to tunnel under Motion declared Power Co. seconded by Crosby to adopt Resolution 79-29, allowing Northern States Power Hamel Rd. to serve 900 Hamel. Rd. carried Northwestern Bell Telephone Co. Motion by Laurent, seoonded by Lutz to adopt Resolution 79-30, allowing Northwestern Bell Telephone Co. to bury cable under W illow Dr. and on the north side of Chippewa Rd. Motion declared carried 4. POLICE DEPARTMENT Labor Negotiations Mayor Anderson and Councilmember Crosby reported their findings regarding a labor negot- iator. Council decided that interested parties should attend the July 3rd meeting with a written proposal as to cost and estimated time. 5. PUBLIC WORKS DEPARTMENT 217 Road grader Representatives of Ziegler and Borchert -Ingersoll briefly reviewed their respective machines and models other than those that were bid. Thomas Crosby reported that he had talked with Sherburne Co., McCrossan, and the S.J. Groves Co, regarding the 2 machines. Be stated that there had never been a complaint about the size of the present grader and perhaps a smaller grader would suffice. He also stated that he was not concerned about the time it would take to make a decision because the city was spending a great deal of money and all aspects should be explored. Mayor Anderson stated that the Road Committee had recommended a 14G model and in talking to Robbinsdale they did not feel that such a model was to large. Lyle Swanson stated that other companies could be called if Council wished to delay making a decision. Motion by Reiser, seconded by Crosby to table the matter until July 3, 1979. Motion declared carried Employee Motion by Laurent, seconded by Reiser to re -hire James Dillman beginning June 20th, at $6.96 per hour, the salary he was earning when he terminated employment May 18, 1979. Motion declared carried 6. INDEPEBIENCE BEACH NEIGHBORHOOD PARTY Motion by Reiser, seconded by Crosby to allow closing of streets in the Independence Beach area on August 18, 1979 from 12:00 noon until 7:00 p.M., for a neighborhood picnic. Motion declared carried 7. BERNARD WENDLAND TAX FORFEIT LOTS Motion by Crosby, seconded by Laurent to adopt Resolution 79-31, acquiring Lot 17, Block 9, Independence Beach, for public purposes. Motion declared carried 8. HERB BEATTY, VARIANCE Robert Denis presented variance request from Mr. Beatty for installation of an electro-osmosis septic system on Lot 1, Block 1, Paradise B'aven. Richard Schaeffer explained that if an ordinance deprives a property of its value then variance must be granted. Discussion of inspection safeguards that will be included in the new septic system ordinance. Mr. Beatty explained that there are 2 working systems in Medina and that 2 months ago such a system could have been installed and now it cannot. He requested that a variance be grant- ed with conditions that will be outlined in the new ordinance. Motion by Crosby, seconded by Lutz to table the request for a variance until a septic system ordinance is adopted. Motion declared carried 9. DON DYKHOFF, VARIANCE Robert Derus presented a request for a 20 ft. front yard variance to allow the placement of a garage on Lot 2, Block 1, Hunter Farms. Discussion of the site plan and the fact that Mr. Dykhoff has sufficent property on which to place the garage without seeking a variance. Motion by Lutz, seconded by Crosby to table the request for a variance pending information as to the proposed use and location. Motion declared carried 10. ED CALDWELL Motion by Crosby, seconded by Lutz to authorize the attorney to prepare a resolution combin- ing Lot E and Lot 2 of Registered Land Surrey 1347. Motion declared carried 11. VERN IMAM Robert Denis presented plans of Mr. Isham to divide 5 acres, previously known as the Medicine Lake Bus Co, property, into a 1.8 and a 3.2 acre site, under ordinance number 159. Discussion of the need for more details as to landscaping and location of existing build- ings. Motion by Crosby, seconded by Lutz to resubmit the platting request to the planning COMMisS— ion for a study of the total area, concurring that the Council has no objection to the division, Motion declared carried 12. HAMEL RD., PINT() DR., TOWER DR. Mayor Anderson stated that he had asked that this item be put on the agenda for further discussion. William Reiser stated that if an Industrial Park is wanted in Medina then proper streets are a must. Richard Schieffer stated that ordering plans and specifications will provide Council with costs of the project. Assessing costs will come at a later date. Thomas Anderson stated that a 4/5 majority vote should be attached to the assessing policy as a safeguard for those concerned about the assessments. Motion by Crosby, seconded by Reiser to adept Resolution 79-32, ordering plans and specifi- cations for improving Hemel Rd., Pinto Dr., Tower Dr., with the intention of obtaining bids on the project. And to stipulate that a 4/5 majority vote on the assessments will be required. Motion declared carried 13. MEDINA MORNINGSIDE SEWER Thomas Crosby reported that Salsbury Adams of Metro Waste sent Medina's application to PCA without the recommendation of the West Control Commission but pCA now had their recommendation. Thomas Anderson stated that he had advised the PCA to skip step 1 and go to 2 and 3 and run the risk of not being approved. Lyle Swanson reported that the pCA will be taking action on the Step 2 and 3 application on June 26th, if approved it will then go to the Federal Government for funding. *red Keller stated that he had not received an answer from Medina on his application request of April 26th. He added that Medina is allowing Orono to dictate how Medina will be developed as they are doing with their own residents. Thomas Crosby stated that he would call Orono to determine if they would take a different attitude if the application were only for 23 units, as originally requested by Mr. Keller. 14. TAX FORFEIT LAND Motion by Crosby, seconded by Laurent to adopt Resolution 79-33 regarding sale of non-eervat- ion land. Voting No: Crosby, Anderson, Laurent, Lutz, Reiser Motion not carried. 15. PRIVATE ROADWAY AGREEMENTS Discussion of the need`for specifications needed to build private roads. planning Commission agreed that 4 homes should be allowed on a private road. Motion by Crosby, seconded by Reiser to adopt a roadway policy incorporating planning Comm— ission items as follows and to have road committee formulate rules , regulations and Epec3if- ations: 1. No more than 4 homes shall use a common driveway 2. No parcel served shall be smaller than 5 acres 3. Construction of a private roadway shall be in conformance with basic roadway construction specifications of the city 4. A petition for takeover by the city shall require signatures of a majority of those involved 5. Maintenance shall be such that emergency vehicles may travel upon said roadway. Motion declared carried 16. INDEPENDENCE BEACH SEWER Donna Roehl presented a list of home and cabin owners at Independence Beach not connected to the sewer. Council advised sending a letter to those owners advising them of the ordinance. 17. SAC CHARGE ORDINANCE 149 Motion by Crosby, seconded by Lutz to authorize the attorney to prepare an amendment to the SAC charge ordinance, 149, regarding collection of charges. Motion carried 18. ASSESSING Discussion of the assessing report from Hennepin County and a report by Mayor on an assessor who has expressed interest in working for Medina.
