And The Wood's Estates Of Riverdale Residential Subdivision RESOLUTION NO. 2019-53 RESOLUTION TO EXTEND THE PRELIMARY PLAT DEADLINE FOR WOODS CONSTRUCTION AND DEVELOPMENT INC. AND THE WOOD'S ESTATES OF RIVERDALE RESIDENTIAL SUBDIVISION WHEREAS,the City Council of the City of Riverdale("City")has entered into an Agreement with Woods Construction and Development Inc for the future residential subdivision known as Wood's Estates of Riverdale and this agreement is dated October 10,2017; and, WHEREAS,the City previously approved the preliminary plat for the Wood's Estates of Riverdale subdivision in July 2018; and, WHEREAS, City ordinance indicates that the previously approved preliminary plat expires six months after approval and gives the option for the developer to request an extension in Section 25.07; and, WHEREAS,the City Council,with advice from the Planning and Zoning Chairperson Bill Briesch,may extend this expiration date; and, WHEREAS,the Planning and Zoning Commission Chairperson Bill Briesch, submitted an email to the City Administrator Tim Long and that he advised to not extend the preliminary plat agreement as requested; and, WHEREAS,the Developer has made a written request to extend the preliminary plat approval until March 1,2020 which is attached as Exhibit A; WHEREAS,the City Council and its legal counsel have reviewed all ordinances, statutes, agreements and policies and determined that the City Council may grant this extension and allow the Final Plat approval process to proceed next; and, NOW THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, SCOTT COUNTY, IN THE STATE OF IOWA: Approves the extension date for the preliminary plat for the Woods Estates of Riverdale as requested until March 1, 2020.
