AN ORDINANCE APPROVING THE VACATION OF A PORTION OF COLORADO AVENUE PUBLIC RIGHT-OF-
WAY AS PLATTED IN THE PALISADES SUBDIVISION, PLAT "A", AND AMENDING LOT 6, BLOCK 4, LOT 18,
BLOCK 2, AND LOTS 17A AND 17 B AND ACCEPTING A DEDICATION OF PROPERTY TO MAINTAIN THE
RIGHT-OF-WAY WIDTH OF FIFTY FEET AND REALIGNING THE COLORADO AVENUE RIGHT-OF-WAY
WHEREAS, Benjamin and Melissa Byrd at 854 Rainbow Drive, Dennis and Patricia Byrd at 826 Colorado
Avenue, and Justin and Alisa Marcus at 818 Colorado Avenue in Moab, Utah 84532, and as the "Owners"
of record of the properties described as Lot 6, Block 4, Lot 18, Block 2 and Lots 17a and 17b of palisades
Subdivision , Plat "A", have applied for an amended plat with a partial vacation of the platted but
undeveloped street right-of-way (ROW) known as Colorado Avenue; and
WHEREAS, Owners have negotiated an additional dedication of right-of-way for Colorado Avenue to the
City of Moab to maintain the required minimum right-of-way width of fifty (50) feet as described in
Attachment "B" and effectively realign the street to be in line with previously constructed
improvements; and
WHEREAS, the Moab City Council ("Council") held a duly advertised public hearing on August 26, 2014,
to hear public testimony and review the request to realign the described portion of the Colorado
Avenue right-of-way as shown on the attached plat (Attachment A); and
WHEREAS, Council, as evidenced by the adoption of Ordinance #2014-08, has determined that the
request for the realignment of the described portion of Colorado Avenue is in keeping with the General
Plan Elements for Transportation that "involves planning for arterial, collector, and local traffic
circulation", and found that the applicant has proven "good cause" to support the requested vacation;
and
WHEREAS, Council additionally found that the proposed vacation:
• Does not conflict with adopted policies or plans,
• Will not generate adverse impacts on the health, safety, and/or general welfare of tha
community,
• Will not result in future traffic problems,
• Provides for an adequate street right-of-way width to accommodate projected traffic impacts
for future development,
• Streets and intersections in the neighborhood will not see a decrease in an appropriate Level of
Service (LOS),
WHEREAS, it has been determined that the amended ROW, as adjusted by the applicants, satisfies the
intended use of the street by the adjacent properties; and,
WHEREAS, Council, after due deliberation based on the evidence and testimony presented at said public
hearing, has found that the requested vacation of existing right-of-way, and dedication of additional
right-of-way for the realignment of Colorado Avenue satisfies with the goals of the General Plan
regarding transportation and circulation, "To achieve a safe, efficient, and convenient transportation
system that addresses the need for all levels of circulation"; and,
NOW, THEREFORE, subsequent to consideration of Staff recommendations and having reviewed the
technical aspects of the proposed right-of-way vacation and dedication, Council, by the adoption of
Ordinance #2014-08, hereby approves the request for the realignment of the public right-of-way for the
currently platted Colorado Avenue as indicated on Attachment A.
PASSED AND ADOPTED by action of the Moab City Council in open session this
9th day of September, 2014_

Title: Decision to Adopt Ordinance #2014-08, an Ordinance Approving the Amended Plat and
Vacation of a Portion of Colorado Avenue and Accepting Additional Property as Right -of -Way to
Realign the Street Seventeen Feet to the South

Background/Summary:
The proposed vacation of Colorado Avenue consists of seventeen (17) feet along the north side
of the street. This vacation will allow the adjacent three lots to develop as other lots in the area.
In addition, a dedication from Pat and Dennis Byrd of seventeen (17) feet on the south side of
Colorado Avenue will be dedicated to the city to maintain the appropriate right-of-way width.
The vacation and dedication results in a realignment of the Colorado Avenue right-of-way that
will line up with improvements made for Phase Two of The Preserve Subdivision and will allow
the street to extend to the west if necessary.
A public hearing was held by Council at the meeting held on August 26, 2014.
Options:
Council may:
i. Approve Ordinance #2014-08 as written;
2. Approve Ordinance #2o24-o8 with changes;
3. Not approve Ordinance#2o24-08 and stop future through development of
the street to the west;
4. Table the ordinance if additional information is needed.
Staff Recommendation: Staff recommends that Ordinance #2014-08 be adopted so a better
alignment for the street will be in place for future needs.
Recommended Motion: I move to adopt Ordinance #2014-08 as submitted.
