HomeMy Public PortalAbout2001_03_13_r033 The Town of 1 .eesburg, . $ $ '''-y lrglnla PRESENTED March 13. 2001 RESOLUTION NO. 2001-33 ADOPTED March 13.2001 A RESOLUTION: PERMITTING WITHDRAWAL OF LEESBURG COMMONS REZONING APPLICATION AND ASSOCIATED APPLICATIONS WHEREAS, by letter dated February 23, 2001, counsel for the applicant asked that ZM-157, the Leesburg Commons rezoning application, and all associated applications be permitted to be withdrawn without prejudice; WHEREAS, Section 13A-7 of the Zoning Ordinance provides that Council may permit a rezoning application to be withdrawn without prejudice, allowing the application to be resubmitted at any time; WHEREAS, new filing fees would be required in the event the applications were withdrawn and then resubmitted; "'--- WHEREAS, the applicant has diligently pursued the applications, revising them numerous times in an attempt to address the issues raised during the review process, but major issues remain outstanding; and WHEREAS, staff recommends that the applications be permitted to be withdrawn without prejudice. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that ZM-157, the Leesburg Commons rezoning application, and all associated applications are deemed to be with- drawn without prejudice.
