''-r lrglnla PRESENTED: March 13, 2001 RESOLUTION NO. 2001-35 ADOPTED: March 13, 2001 A RESOLUTION: APPROVING SPECIAL EXCEPTION #SE 2000-13 THE MIDDLEBURG BANK TO PERMIT DRIVE-IN FACILITY WHEREAS, the Middleburg Bank has requested special exception approval for a bank with drive-in facility at its proposed site; and WHEREAS, the property is located in the B-3 (Community Retail/Commercial Zoning) District; and WHEREAS, on February 1, 2001, the Planning Commission recommended conditional approval of this application; and '- WHEREAS, on February 27,2001, the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for banks with drive-in facilities, as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE RESOLVED by the Town Council of Leesburg Virginia as follows: Special Exception application #SE 2000-13 The Middleburg Bank identified in the Loudoun County Land Records as Tax Map #189 cell 49 parcel 2489 as shown on the Special Exception Concept Plan, received on November 15, 2000 and any future version of the plan that incorporates the conditions contained herewith, is hereby approved subject to the following conditions: "---- -2- RESOLUTION: APPROVING SE-2000-13 - MIDDLEBURG BANK 1. The development on the site will be in accordance with the special exception plat prepared by William H. Gordon Associates, Inc. dated October, 2000. 2. The applicant will remove the chain-link fence along Fort Evans Road. 3. Any mechanical equipment mounted on the roof of the proposed bank building will be screened from the bank parking lot and the travel ways on the proposed bank's property. 4. The footprint/configuration of the bank may be adjusted on the location shown on the Special Exception Plat to allow for safe and convenient traffic circulation. 5. Because the site is within the H-2 Corridor Overlay District, any new development will need to be reviewed by the Board of Architectural Review.
