Mayor Harker called the regular meeting of the City Council to 2. order at 7:30 P. M. Invocation was given by Mayor Harker, 3. following which he led the Pledge of Allegiance to the Flag, 4. ROLL CALL: PRESENT: Councilmen - Dickason, Merritt, Nunamaker, Tyrell Harker ABSENT: Councilmen -None ALSO PRESENT: Asst. City Attorney Flandrick and City Manager Koski 5. APPROVAL OF MINUTES: Regular meeting of Febr. 1, 1966 Councilman Merritt moved to approve the minutes of Febr. 1, as mailed, Councilman Dickason seconded, and the motion was :. unanimously carried. UNFINISHED BUSINESS: 6. ORDINANCE NO. 66 -184: 2nd read. re Variance Procedure Asst. City Attorney Flandrick read title to Ordinance No. 66- 184 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE PROVISIONS OF ARTICLE 1 8 OF ARTICLE I X OF THE TEMP;. CiTY MUNICIPAL CODE, RELATING TO ZONE VARIANCES AND CONDITIONAL:, USE PERMITS. Councilman ,Tyrell moved to waive further reading of Ordinance No. 66 -184, Councilman Merritt seconded, and the motion carried unanimously. Councilman Nunamaker moved to adop Ordinance No. 66 -184, Councilman Tyrell seconded and the motion was unanimously carried. Asst. City Attorney Flandrick stated the staff has several re- quests for modification and requests this be an urgency ordi- nance. He then read title to Ordinance No. 66 -187 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE r'RO VISIONS OF ARTICLE 18 OF ARTICLE IX OF THE TEMPLE CiTY MUNICIPA. CODE, RELATING TO ZONE VARIANCES AND CONDITIONAL USE PERMITS (URGENCY ORDINANCE). Councilman Tyrell moved to waive further reading and adopt Ordinance No. 66 -187, Councilman Nunamaker seconded, and the motion was carried by a unanimous roll call vote. 7. ORDINANCE NO, 66 -185: 2nd read. re 4 hr. parking in parking lots. Asst. City Attorney Flandrick read title to Ordinance No. 66 -i8�" AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING SECTION 7321 TO THE TEMPLE CITY MUNICIPAL CODE. Councilman Tyrell moved to waive further reading of Ordinance No. 66 -185, Councilman Nuna- maker seconded and the motion carried unanimously. Councilman Tyrell moved to adopt Ordinance No. 66 -185, Councilman Nunamakei seconded, and the roll call vote to carry was unanimous. 8, ORDINANCE NO. 66 -186: 1st read. re Non - Conforming Status of Land on Street Widening Asst. City Attorney Flandrick read title to Ordinance No. 66• -1'a: AN ORDINANCE OF THE CiTY OF TEMPLE CITY AMENDING SECTION 1721 OF THE TEMPLE CITY MUNICIPA5. CODE RELATING TO NON - CONFORMING LOTS. Councilman Tyrell moved to waive further reading of Ordinance No. 66 -185, Councilman Merritt' seconded, and the motion was unanimously carried. No further action was taken a: this was the first reading of the ordinance. PUBLIC HEARING: 7 :30 P. M, APPEAL FROM PLANNING COMMISSION DECISION, VARIANCE CASE #65 -173, RUDY STPNAD, 9733 LAS TUNAS DR. Mayor Harker declared the pubic hearing open and requested the Planning Director to outline the case. Planning Director Cushman statd the request for a quick stop type food market with less than required parking spaces was pre- sented to .:he Planning Commission. This would be part of a national chain. Presentiy there is a service: station located there which would be removed, The parking request shows seven 863 Council Minutes, February 15, 1966, page 2 parking spaces in front and possibly three ;r the earn Require ments for 2624 sq. ft. would be 13 spaces Mayor Harker asked if anyone in the audience wished to speak. Rudy Strnad, 1018 Bradshaw Dr., Monterey Park, representing the market and variance request, offered another plan for parking spaces which would give them 8 spaces in front and 3 in the rear., Ernest Hinrichs, owner of the property, stated the buildings are old and the property needs improvement and he felt in granting this variance it would greatly improve this corner and the commut ity around it. Wallace GIidden, 5809 Primrose, stated he was a realtor and was interested in the development of this corner. He advised only something of this nature could go in there due to its size. Mayor Harker asked if anyone else wished to speak and no one els: camefbrward to address the Council. Councilman Merritt moved to close the public hearing, Councilman, Nunaniaker seconded and the motion carried unanimously. Councilman Tyrell felt it would be a logical development and the parking was not that critical. Councilman Merritt felt a low wall should be constructed between the' °Oarking area and the sidewalk of a decorative type and he made a motion to over -rule the Planning Commission without pre- judice and instruct the City Attorney to draw a resolution with conditions, Councilman Tyrell seconded the motion. Following dis cussion the roll call vote was as follows: AYES: Councilmen-Dickason, ?der- i tt, Nunamaker, Tyrell, Harkc =r NOES: Councilmen -None ABSENT: Councilmen -None PUBLIC HEARING: 7:30 P. M. RE AMENDMENTS TO ZONING ORDINANCE PERTAIN H TO SIDE AND REAR YARD SETBACKS IN RESIDENTIAL ZONES The City Manager requested this public hearing be tabled until the meeting of March 1, 1966, which was approved. 9. RESOLUTION NO,, 66 -575: appointing Administrative Interne City Manager Koski read title to Resolution No. 66 -575 A RESOLU- TiON OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING AN ADMINISTRATIVE INTERNE. Councilman Dickason moved to adopt Resolution No: 66 -575, Councilman Merritt seconded, and the motion was carried unanimously. NEW BUSINESS: 10. RESOLUTION NO. 66 -576: Requesting Registrar of Voters Servi:;ec in Annexation No. 10 election City Manager Koski read title to Resolution No. 66 -576 A RESOLU- T6ON OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING ME BOARD OF SUPERVISORS OF THE, COUNTY OF LOS ANGELES TO PERMIT THE REGISTRAR OF VOTERS OF, SID COUNTY TO RENDER SPECIFIED SERA VICES TO THE CITY OF TEMPLE CITY RELATING TO THE CONDUCT OF A SPECIAL ELECTION TO BE HELD BY SAID CITY ON MARCH 22, 1966. Councilman Tyrell moved to adopt Resolution No. 66 -576, Council- man Merritt seconded, and the motion was unanimously carried. 11. RESOLUTION NO. 66 -577: apponting part -time Park Maintenance Personnel City Manager Koski presented Resolution No. 66 -577 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PART - TIME AND TEMPORARY EMPLOYEE, Councilman Tyrell moved to adopt Resolution No. 66 -577, Councilman Merritt seconded, and the mo- tion carried unanimously. 12. SET PUBLIC HEARINGS t Curb & Cutter a. :roolley St., north side, between Sultana & Livia b. Live Oak Ave., south side,: Rr,seme d westerly to Eaton Wash curb and gutter, and st_re_c widening improvement Councilman Tyrell moved to set public hearings For March 1, 1966 at 7 :30 P. M., Councilman Dickason seconded, and the motion was carried unanimously, 864 Council Minutes, February 1, 19b6, p19'r 13. SULTANA STREET I Pt: 31 EMEN` .'S: Approval of Agreement between City and Property Owners RE Right of ;Jay & street improvements The City Manager reported right of way dedications were necessar;, for this improvement and there was only one troublesome spot and he recommended condemnation for this. He recommended the City accept the Agreement and authorize the Mayor to execute same on behalf of the City for dedication of right of way. Estimated cost of road alignment is $1200. and once received proceedings can be commenced to acquire the properties and he requested a public hearing be set for March 1 to establish proceedings. Councilman Tyrell moved to accept the dedications and instruct the Mayor to sign the Agreement accepting dedication and set a public hearing for March 1 to process and condemn, Councilman Nunamaker seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 14. TEMPLE CiTY IMPROVEMENT #4: GREEN STREET - SEWERS: award of contract. City Manager Koski read a report from City Engineer Moller re- commending the construction project be awarded to L. D..& M. Construction Co., the low bidder, for $8,168.75, which is 25% below the County Engineer's estimate. Councilman Tyrell made a motion in accordance with the recommend- ation, Councilman Merritt seconded, and the motion carried unan- imously. 15. RESOLUTION NO. 66 -579: adopting plan for State apportioned 186.1 funds City Manager Koski stated this was for the specific project on Baldwin Ave. improvement and read title to Resolution No. 66 -57�; RESOLUTION OF THE CITY COUNCrL: OF THE CilY OF 'TEMPLE CITY ADOPT- ING AND SUBMITTING A SPECIFIC PLAN FOR EXPENDITURE OF STATE APPORTIONED (186.1) FUNDS. Councilman Tyrell moved to adopt Resolution No. 66 -579, Councilman Merritt seconded, and the motion carried unanimously. 16. TRAFFIC COMMISSION RECOMMENDATIONS: Item 7. Las Tunas Dr. & Reno: reaffirm plan for raised portion of island on Las Tunas Dr. westerly of Reno and to place 9 unit reflector and "No Left Turn" on median divider west line of Reno; for westbound traffic. Administrative Assistant Recupero presented the above recommend: tion and following a lengthy discussion Councilman Merritt moved to refer this matter back to the staff, Councilman Dickason - seconded, and the motion carried unanimously. Item 10 (2) Broadway & Barela - Passenger Loading Zone: recom- mend white loading zones at 7th Jay Adventist Church south side of Broadway & west side of Barela. Administrative Assistant Recupero presented the above recommend:.] tion. Following considerable discussion Councilman Merritt moved to have the staff check further into the background of th.: request and to find out how much it would cost for two signs, Councilman Tyrell seconded, and the motion carried unanimously. item 10. (1) rescind parking restriction on east side of Agnes Ave. southerly of Ha l lwood Or. Administrative Assistant Recupero presented this recommendation. Councilman Merritt moved to approve, Councilman Tyrell seconded, and the motion carried unanimously. 17. RESOLUTION NO. 66 -580: Warrants & Demands City Manager Koski presented Resolution No. 66 -580 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $:1,366,52, DEMAND NOS. 7607 THROUGH 7685. Councilman Tyrell moved to adopt Resolution No. 66 -580, Councilman Nunamaker seconded, roll call vote to carry as fol love: AYES: Counci i ven -D ickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Counci lrne;; -None 18. COMMUNICATIONS: City Manager Koski presented a letter from the Exchange Club re- questing the week Febr, '13 -19 be proclaimed "National Crime Pre vention Week ". Councilman Dickason so moved, Councilman Merritf . seconded, and the niotio:i oz-tried unanimously, 865 Council Minutes, February 15, 1 Sri The City Manager presented a req.esz from the Cadiellla Festival Committee for use of Temple City Park and the parking lot for carnival activities, approval of the parade permit which has been reviewed by the Sheriffs Dept., and a request for a center line on Las Tunas Dr. as we have for the past two years. They also have submitted a certificate of liability insurance. Councilman Merritt moved to approve, Councilman Tyrell seconded}: and the motion carried unanimously. 19. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Robert Knott, 9518 Lower Azusa Rd., stated he represented 12 property owners on Lower Azusa between Fiesta and Cloverly who petition the Council for elimination of the hazard of water standing in the streets where school buses load and unload. ';Dater stands practically the length of this block. There is nc curb. The new storm drain is higher than the street and so the water does not drain off. Following a lengthy discussion it was felt by installation of curb and gutter and having the street properly engineered that the water would drain away properly. The staff will prepare a petition which Mr. Knott said he would sign and the staff will work on this and get enough signatures if possible and this can be accomplished. Also the staff will contact the school and possibly have the bus stop changed. Paul Fowler, 4515 Fiesta, also complained of the water backing up from Lower Azusa to his property. 20. MATTERS FROM CITY OFFICIALS: Asst. City Attorney Flandrick stated there was a problem with the escrow of the Wells property. The sellers do not like the local escrow. He recommended until solved that a warrant be issued to Martin & Flandrick 'r!st Account in the amount of $15,000, and they would handle the closing of the escrow. Cour cilman Tyrell moved to authorize a draft for $15,000. payable to the Title Trust Account, Councilman Nunamaker seconded and the motion was unanimously carried. Asst. City Attorney Flandrick advised they had sent out letter: to the Baldwin Ave. property owners and seven letters had been received from seven property owners. He recommended $151,00C., be placed in their Trust Account so they can be paid directly on signing. Councilman Merritt so moved, Councilman Tyrell seconded, and the motion carried unanimously. Planning Director Cushman presented a letter from the City En- gineer recommending the following re Tract No. 30243: 1. Approval of the map, 2. Acceptance of the right to restrict the construction of additional residential buildings, as offered for dedica- tion on said map, 3. That the Council find that Baldwin Builders, subdivider of subject Tract #30243 ( Ba1dwn Condominium) has in good faith attempted to secure the signatures of So. Calif. Edison Co. and Merchants Trust Company, has been unable to do so and a refusal to accept the map for recording would work an undue hardship on the subdivider. L. K. Councilman Nunamaker moved to instruct the City Attorney to prepare a Resolution approving the final tract map and the re- commendations of the City Engineer, Councilman Dickason second- ed and the motion carried unanimously. City Manager Koski requested Council approval for his attendant.:. at the City Managers Meeting , Febr; 23, 24 and 25, and for re- imbursements of the costs, Councilman Dickason moved to approz Councilman Merritt sec :,ideds and the motion carried unanimously Mayor Harker recognized tshe students from San Gabriel High School who attended the Couunc i l eL i ng and invited them to come anain. 866 Council Minutes, Fehr° ;)ary 15, `9'-6; p -a.. 5 Planning Director Cushman annoc1ced this would be his last meet- ing with the City Counc i l and he had enjoyed an educational and pleasant four years working for the City. Mayor Harker stated the feeling was mutual and wished him much success in the future: :. City Manager Koski reported a meeting was scheduled on Thurs. night for all those whose names appeared on the petition in connection with the Temple City Animal Hospital. He advised also that Dr. Jobe and his attorney and the City Attorney and he had met on Monday. Following the meeting with the petition, they will attempt to negotiate a settlement. A determination is to be made by the Council at their meeting on March 1. 21. ADJOURNMENT: Councilman Tyrell moved to adjourn, Councilman I4unamaker second- ed and the motion carried unanimously.
