THE CITY OF BEL AIRE, KANSAS ORDINANCE NO. /'f~ AN ORDINANCE PERTAINING TO WATER SERVICE AND AMENDING SECTIONS 9, la, AND 16 OF ORDINANCE NUMBER 97. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: Section 1. Amending Section 9 of Ordinance Number 97 Section 9 of Ordinance Number 97 of the City of Bel Aire, Kansas is amended to read as follows: "Section 9. SHUT OFF NOTICES Water service will be terminated for nonpayment upon notice to the customer at the billing address when the bill is unpaid on or before the lath day of the month following billing. If service is terminated, a reconnect fee of $20 will be charged in addition to delinquency charges before water service will be reinstated. The disconnect notice shall provide the customer with the amount of the unpaid debt, information concerning the customer's right to request a hearing within five (5) days of the date of the notice, and notice of the date that service will be terminated if the debt remains unpaid. When any customer has been previously notified of a delinquency as set out herein and is delinquent a second time, requiring notice, a $50 deposit may be required to continue water service. When a deposit is required, the water meter shall be pulled and not replaced until the deposit is paid in full. Upon terminating the service, the deposit shall be returned to the customer together with interest at the statutory rate less any outstanding water charges due to the City of Bel Aire." Section 2. Amending Section 10 of Ordinance Number 97 Section 10 of Ordinance Number 97 of the City of Bel Aire, Kansas is amended to read as follows: "Section 10. CHECKS RETURNED FOR INSUFFICIENT FUNDS A $20 charge will be charged back to the customer's account for a check returned for insufficient funds." Section 3. Amending Section 16 of Ordinance Number 97 Section 16 of Ordinance Number 97 of the City of Bel Aire, Kansas is amended to read as follows: "Section 16. SPECIFIC WATER PRESSURE The City of Bel Aire does not guarantee to maintain any specific water pressure for its service and no complaint concerning the pressure shall give any right of claim against the City of Bel Aire." All other sections of Ordinance Number 97, not previous ly amended or repealed, shall remain in full force and effect. Section 4. Effective Date This Ordinance shall take effect and be in force from and after its publication in the official city newspaper.
