PLEDGE OF ALLEGIANCE PRAYER BY MR. WISSEL President Wissel presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Absent was Kelley Cruse - Nicholson. Also present were: Bill Smith, Street Department; Tony Foster, Metropolitan Development; Bill Thistlethwaite and Christy Mosey Park Department; Mike Foley, President of the Park Board; Tammy Glenn, City Controller; Walt Chidester, City Attorney; Eric Marsh, Whitewater Community Television; Karen Chasteen, City Clerk, Monica Burns, Deputy City Clerk and Scott Rigney, Cardon & Associates (Arbor Trace). APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the meeting of October 19, 2009, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ Leaves are being removed until the first snow ■ Drivers need to be aware of the many road and sewer construction projects — much patience will be needed in the next two years REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the October 29 & 22, 2009, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS ■ Nominations for the Economic Development Committee will be accepted at the November 16 meeting. MISCELLANEOUS BUSINESS Mayor Hutton introduced Eric Marsh, new Executive Director for Whitewater Community Television Common Council Minutes November 2, 2009 Page 2 of 4 ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 68 and 69 -2009 on first reading by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed. ORDINANCE NO. 68 -2009 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 55- 2008 KNOWN AS THE 2009 SALARY ORDINANCE (Street) The Clerk read Ordinance No. 68 -2009 on first reading by title only. Presented by Mr. Smith, this ordinance would authorize the deletion of one Laborer and transfer of one temporary employee to a permanent position as General Laborer to Street Department personnel. This Ordinance would also authorize the adjustment of the salary schedule and include benefits accordingly for the remainder of 2009. Mr. Elstro moved to advance Ordinance No. 68 -2009 to second reading and to suspend the rules and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 68 -2009 on second reading by title only. Council President Wissel declared Ordinance No. 68 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 68- 2009, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 68 -2009 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 68 -2009 on third reading by title only. Ordinance No. 68 -2009 was adopted with an 8 -0 roll call vote. Upon a vote viva voce, the motion failed and Ordinance No. 69 -2009 will be brought back on second reading November 16, 2009. Presented by Ms. Chasteen, this Ordinance would authorize the Office of the City Clerk to accept execution and photograph fees while accepting Passport /Card applications. Mr. Chidester requested this Ordinance be held on second reading to allow additional time for review by the Law Department. ORDINANCE NO. 64 -2009 — AN ORDINANCE AUTHORIZING A MAJOR AMENDMENT TO ARBOR TRACE PLANNED UNIT DEVELOPMENT AND AMENDING ORDINANCE NUMBER 69 -2005 (Metro) The Clerk read Ordinance No. 64 -2009 on second reading by title only. Mr. Wissel presented the Plan Department staff report. Mr. Parker moved to amend Ordinance No. 64- 2009 by adding the following recommended commitments: • The rehabilitation wing, car port and garage will substantially match the existing building in regard to building material, pitch of roof and detailing. • Additional landscaping sufficient to buffer the garage and southern boundary of the lot will be installed before a Certificate of Occupancy will be issued. • Parking access off the potential extension of South 37th Street will be reduced to a single lane entrance. • The additional parking will be screened with landscaping. The motion was supported by Mr. Miller. Upon a vote viva voce, the motion passed Council President Wissel declared Ordinance No. 64 -2009 as amended on second reading and public hearing. Speaking on behalf of Cardon & Associates was Mr. Rigney. There being no comments against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 64- 2009as amended, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Ordinance No. 64 -2009 as amended to third and final reading and to suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 64 -2009 as amended on third reading by title only. Ordinance No. 64 -2009 as amended was adopted with an 8 -0 roll call vote. ORDINANCE NO. 67 -2009 - AN ORDINANCE OF THE CITY OF RICHMOND INDIANA CONCERNING PARK IMPROVEMENTS BY THE PARK AND RECREATION BOARD THROUGH THE ISSUANCE AND SALE OF BONDS, AND OTHER MATTERS CONNECTED THEREWITH (Parks) The Clerk read Ordinance No. 67 -2009 on second reading by title only. Presented by Mr. Chidester, Mr. Thistlethwaite, Mr. Stewart and Ms. Glenn, this Ordinance would authorize the Park Board to issue a bond for renovations, infrastructure, etc at several park facilities. Council President Wissel declared Ordinance No. 67 -2009 on second reading and public hearing. Speaking in favor were Messrs. Thistlethwaite and Foley. There being no comments against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 67 -2009, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion failed. Dissenting was Mr. Miller. Ordinance No. 67 -2009 will be heard on third reading at the November 16, 2009 meeting.
