RESOLUTION NO. 2001-59 ADOPTED May 8, 2001
A RESOLUTION: AUTHORIZING A TIME EXTENSION FOR COMPLETION OF
PUBLIC IMPROVEMENTS AND APPROVING A PERFORMANCE
GUARANTEE FOR POTOMAC STATION SECTION 6EFG
WHEREAS, M/I Schottenstein Homes, Inc., the developer of Potomac Station Section
6EFG, has not completed all the required public improvements in accordance with the approved
construction drawings and town standards within the two-year period agreed to in the contract
for public improvements and previously approved time extension; and
WHEREAS, the developer has requested a time extension to complete the public
improvements; and
WHEREAS, the subdivision is in Loudoun County and the town's bonded improvements
are water and sanitary sewer only; and
WHEREAS, a corporate surety bond froTM the Amefic{tn Motorists Insurance Company
in the amount of $30,069.27 was provided by the developer to guarantee the installation of
public improvements in Potomac Station Section 6EFG; and
WHEREAS, the town's Director of Engineering and Public Works recommends a time
extension to January 13, 2002 for completion of the public improvements.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I.
The corporate surety bond from the American Motorist Insurance
Company in the amount of $30,069.27 is approved to guarantee the installation of public
improvements in Potomac Station Section 6EFG.
