HomeMy Public PortalAbout11-16-2009PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, NOVEMBER 16, 2009 The Common Council of the City of Richmond, Indiana met in regular session Monday, November 16, 2009 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY MR. PARKER President Wissel presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: Residents Dave Dorston and Dan Matheny; Louie Eder; Avis Stewart and Mike Foley, Park Board; Bill Thistlethwaite, Park Department; Scott Zimmerman, City Planner; Karen Chasteen, City Clerk; Mayor Sally Hutton; Walt Chidester, City Attorney; Monica Burns, Deputy City Clerk and Tammy Glenn, City Controller. APPROVAL OF MINUTES Parker moved to approve the minutes of the meeting of November 2, 2009, supported by Welch. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR None REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the October 29 and November 5, 2009 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS ■ URBAN ENTERPRISE ASSOCIATION BOARD MEMBER NOMINATION Council is now accepting nominations to replace Jim Grimm who has resigned from the UEA Board. The nominee must be a resident of the Enterprise Zone, a Republican and a business owner. WAYNE COUNTY CONVENTION & TOURISM BUREAU BOARD MEMBER NOMINATIONS Nominations for a representative from the Travel Industry and the Lodging Industry will be submitted until the December 7, 2009 meeting. Common Council Minutes November 16, 2009 Page 2 of 3 • NOMINATIONS FOR THE ECONOMIC DEVELOPMENT COMMITTEE Nominations will be submitted to Ms. Pappin for consideration by Council. • PARK DEPARTMENT — 260 BUDGET FOR 2010 Mr. Thistlethwaite presented copies of the Park and Recreation Non - reverting Operating Fund 2010 Budget. Funds have been moved into the appropriate categories to more accurately reflect income & expenses in the future. MISCELLANEOUS BUSINESS Mr. Miller announced there will be a meeting on November 30 to discuss the Unified Development Ordinance. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance No. 70 -2009 on first reading by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. ORDINANCE NO. 70 -2009 — A SPECIAL ORDINANCE CREATING A CONSERVATION DISTRICT OF THE PROPERTY COMMONLY KNOWN AS LAURAMOORE FRIENDS HOME The Clerk read Ordinance No. 70 -2009 on first reading by title only. Presented by Mr. Zimmerman, this Ordinance would establish a Historic Conservation District for the Lauramoore Friends Home, located at 504 NW 5th Street. This request has been approved by the Historic Preservation Commission. Ms. Pappin moved to advance Ordinance No. 70 -2009 to second reading and to suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 70 -2009 on second reading by title only. Council President Wissel declared Ordinance No. 70 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 70 -2009, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 70 -2009 to third and final reading and suspend the rules and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 70 -2009 on third reading by title only. Ordinance No. 70 -2009 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 48 -2009 — AN ORDINANCE CREATING A PASSPORT ACCEPTANCE AGENCY (Clerk) The Clerk read Ordinance No. 48 -2009 on second reading by title only. Ordinance No. 48 -2009 was held on second reading upon the recommendation of Mr. Chidester. Common Council Minutes November 16, 2009 Page 3 of 3 ORDINANCE NO. 69 -2009 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 42- 2009 KNOWN AS THE 2010 SALARY ORDINANCE (Street) The Clerk read Ordinance No. 69 -2009 on second reading by title only. Mr. Parker moved to strike Ordinance No. 69 -2009, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. ORDINANCES ON THIRD READING ORDINANCE NO. 67 -2009 - AN ORDINANCE OF THE CITY OF RICHMOND INDIANA CONCERNING PARK IMPROVEMENTS BY THE PARK AND RECREATION BOARD THROUGH THE ISSUANCE AND SALE OF BONDS, AND OTHER MATTERS CONNECTED THEREWITH (Parks) The Clerk read Ordinance No. 67 -2009 on third reading by title only. Presented by Mr. Thistlethwaite, this Ordinance would authorize the Park Board to issue a bond for renovations, infrastructure, etc. at several park facilities. Opposing the issuance and sale of the bonds was Mr. Matheny. Ordinance No. 67 -2009 was adopted with an 8 -1 roll call vote. Dissenting was Mr. Parker. CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
