A RESOLUTION:
AUTHORIZING THE TOWN MANAGER TO ENTER INTO A
MEMORANDUM OF UNDERSTANDING BETWEEN THE TOWN OF
LEESBURG AND THE COUNTY OF LOUDOUN FOR THE
DEVELOPMENT OF THE ROUTE 15 SOUTH K1NG STREET TRAIL
BETWEEN DAVIS AVENUE AND GOVERNOR'S DRIVE
WHEREAS, the town and county are in the process of coordinating two separate Route
15 South King Street widening projects from Governor's Drive south to Woodlea Drive; and
WHEREAS, both widening projects include the development of a trail to accommodate
safe pedestrian and bicycle use; and
WHEREAS, the town's fiscal year 2001-2005 Capital Improvement Program identifies a
future trail project for safe pedestrian and bicycle use along Route 15 south from Davis Avenue
to Governors Drive; and
WHEREAS, the county desires an interim option to provide safe pedestrian and bicycle
use from Davis Avenue to Governor's Drive; and
WHEREAS, Virginia Department of Transportation (VDOT) has provided the town and
the county with a preliminary cost estimate of $300,000 to design, engineer, and construct an
interim project; and
WHEREAS, the design and engineering cost for the respective project is $50,000
included in the preliminary cost estimate of $300,000 as provided by VDOT; and
WHEREAS, in accordance with the respective Memorandum of Understanding, the
town's share of the design and engineering services will be $20,000 or 40%, and the county's
share will be $30,000 or 60% for this phase; and

WHEREAS, the main points of the respective Memorandum of Understanding in terms
of the town's responsibility are as follows:

The town shall be the project administrator.
The design and engineering phase requires a $20,000 financial obligation from the
town, which represents 40% of this phase.
The Town Council will review and approve the final design and final estimated
construction costs prior to proceeding with construction.
The town will consider funding up to a maximum of 40% of the total project
construction costs but no more than $100,000 per VDOT's estimate dated February
13, 2001.
The town will be responsible for maintenance of the trail if, and once constructed.
WHEREAS, the Parks and Recreation Advisory Commission and Director of Parks and
Recreation recommends approval of the Memorandum of Understanding between the Town of
Leesburg and the County of Loudoun for the development of the Route 15 South King Street
Trail between Davis Avenue and Governors Drive.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
The Town Manager is hereby authorized to execute the Memorandum of Understanding
between the Town of Leesburg and the County of Loudoun for the development of the Route 15
South King Street Trail between Davis Avenue and Governors Drive.
