HomeMy Public PortalAbout2001_05_08_r065 - Opposition to Tractebel's Power Plant Appl to SCCThe Town of I eesburg, rgmta RESOLUTION NO.2001-65 A RESOLUTION: PRESENTED May 8, 2001 ADOPTED May 8, 2001 DIRECTING THE TOWN ATTORNEY TO FII.E A NOTICE OF PARTICIPATION IN OPPOSITION TO TRACTEBEL'S POWER PLANT APPLICATION TO THE SCC WHEREAS, Loudoun County Power Company, LLC, commonly known as Tractebel, has filed Application No. PUE010171 seeking State Corporation Commission ("SCC") approval of a power plant to be located just outside of the Town of Leesburg on a site close to schools, parks and thousands of homes, including hundreds of nearby homes in Leesburg; WHEREAS, the Town has requested a public heating by the SCC in Leesburg; WHEREAS, the Town opposes the application for a number of reasons, including, without limitation, that it is contrary to the public interest and the proposed use would have adverse environmental and land use impacts on the Town and its residents; WHEREAS, the proposed use would violate the Loudoun County Zoning Ordinance, and, therefore, the SCC should immediately dismiss the application or defer a hearing on the merits until all local land use approvals have been obtained and any appeals have been exhausted; and WHEREAS, the Town desires to file a notice of participation as a respondent in opposition to the application under the SCC's Rules of Practice and Procedure, in order to participate fully as a party to the proceedings and adequately protect the interests of the Town and its residents. A RESOLUTION: -2- DIRECTING THE TOWN ATTORNEY TO ~.E A NOTICE OF PARTICIPATION IN OPPOSITION TO TRACTEBEL'S POWER PLANT THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The Town Attorney is directed to file with the SCC on behalf of the Town a notice of participation as a respondent in opposition to the subject application.
