TO CONSTRUCT TWO CLASSROOM BUILDINGS ON-SITE. WHEREAS, the Loudoun Country Day School, Inc. has requested special exception approval for construction of two classroom buildings at its existing location; and WHEREAS, the property is located in the R-1 (Single Family Residential Zoning) District; and WHEREAS, on April 5, 2001, the Planning Commission recommended conditional approval of this application; and WHEREAS, on April 24, 2001, the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for the expansion of a general education school, as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE RESOLVED by the Town Council of Leesburg, Virginia as follows: Special Exception application #SE 2001-02 the Loudoun Country Day School, Inc. identified in the Loudoun County Land Records as Tax Map #48, parcel 38 as shown on the Special Exception Concept Plan, received on April 19, 2001 and any future -2- RESOLUTION: APPROVING SPECIAL EXCEPTION #SE 2001-02 THE LOUDOUN COUNTRY DAY SCHOOL, INC. TO PERMIT THE PLACEMENT OF TWO CLASSROOM BUILDINGS ON-SITE version of the plan that incorporates the conditions contained herewith, is hereby approved subject to the following conditions: 1) Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats, development plans, and construction drawings are subject to the applicable town regulations. 2) The Department of Engineering and Public Works will not approve the development plan for this special exception until the comments of the Town Traffic Engineer are satisfied, adequate channel for storm water discharge, sufficiency of storm drainage, or sufficient storm water management is demonstrated, and adequate on-site parking is demonstrated. 3) Approval of the development plan or no adverse impact plan is contingent on approval by the Loudoun County Fire Protection Inspector. 4) All parking spaces, aisles, and entranceways must be paved and landscaped in accordance with the Zoning Ordinance, Land Subdivision Regulations, and the Design and Construction Standards Manual for the Town of Leesburg. 5) The proposed classrooms are not to be fitted with wheels or axles and are to be placed on a permanent foundation, meeting BOCA guidelines. 6) The existing trailers on-site must be either taken off-site or converted into permanent structures (as described in condition #5) prior to occupancy of the proposed classrooms. 7) The proposed HVAC and the 6 HVAC units existing on the classroom building closest to the northern property line, are not to create a noise level that will exceed 55 dBA as measured at any point on the applicant's property lines as certified by an acoustical engineer acceptable to the Town and licensed in the Commonwealth of Virginia. Prior to the issuance of an occupancy permit for a classroom building, applicant shall retain such an acoustical engineer to conduct a study to determine that the proposed HVAC units and the 6 HVAC units existing on the classroom building closest to the northern property line, meet a continuous noise standard of a maximum of 55 dBA at its property lines bordering Old Waterford Knolls. If the study determines that additional mitigation measures besides the parapet and screening in Conditions #8 and #11 are needed, Applicant will adopt the recommendations of the acoustical engineer to meet the 55 dBA noise level. 8) A parapet built to the specifications of applicant's acoustical engineer is to be placed on each proposed classroom building rooftop prior to the issuance of any occupancy permit. -3- RESOLUTION: APPROVING SPECIAL EXCEPTION #SE 2001-02 THE LOUDOUN COUNTRY DAY SCHOOL, INC. TO PERMIT THE PLACEMENT OF TWO CLASSROOM BUILDINGS ON-SITE 9) Five (5) years from the date of issuance of an occupancy permit to Loudoun Country Day School for either of the proposed classroom buildings, the classroom buildings involved in this proposed special exception and the other three classroom trailers currently on-site are to be removed unless the applicant has obtained a special exception to continue their use beyond the 5 year period specified by this condition. 10) If children are allowed to cross Fairview Street to access Loudoun Country Day School, the applicant shall provide a pedestrian crosswalk and flashing school zone signs, subject to approval by the Town Traffic Engineer. 11) The applicant shall provide the plantings recommended by the Town Arborist in the attached review comments dated May 3, 2001 prior to the issuance of occupancy permits for the proposed buildings. 12) This special exception shall be in substantial conformance with the special exception plan dated February 15, 2001 and revised through April 19, 2001.
